În paginile ce urmează cititorul va găsio succintă reflectare a activităţiiAgenţiei de Stat pentru Protecţia Pro-

prietăţii Industrialea Republicii Mol-dova în 1998, încondiţiile când pro-dusul intelectual epe cale să devinăun factor defini-toriu în dezvoltareaeconomico-politicăa statului.

Aruncând o privireasupra perioadeicare s-a scurs din1992 (anul fondăriiAGEPI), vom con-stata că în acest răs-

timp au fost elaborate şi adoptate princi-palele acte legislative privind protecţia pro-prietăţii industriale, s-a constituit un sistemfuncţional bazat pe criterii universale.Acesta din urmă, la rândul său, a imprimato nouă motivare efortului creativ alinventatorilor şi cercetătorilor, oferindu-iavantajele încadrării în mecanismele depiaţă. În aceeaşi ordine de idei numărulcrescând al solicitărilor agenţilor eco-nomici denotă interesul lor de a obţineproduse competitive pe piaţa internă şi, înspecial, pe cea externă.

Concomitent, AGEPI se implică direct înstimularea creativităţii, promovează siste-matic realizările inventatorilor, acordându-le inclusiv suport financiar pentru a par-ticipa la expoziţiile, saloanele şi târgurileinternaţionale de specialitate. În anul dereferinţă circa 30 de invenţii brevetate înRepublica Moldova au fost prezentate laExpoziţia Internaţională şi Jocurile Olim-pice ale inventatorilor “Genius ‘98”

(Budapesta), cucerind 11 medalii. LaTârgul Internaţional Bucureşti – 1998AGEPI a expus, de asemenea, un set imp-unător de invenţii. Alte adrese expoziţ-ionale de prestigiu: Geneva, Pittsburgh, Ca-sablanca. Sub auspiciile Agenţiei se des-făşoară anual la Chişinău Saloanele Inter-naţionale pentru tineret “Inventică, Crea-tivitate, Inovare” (în octombrie 1998 –ediţia a IV-a).

Date fiind exigenţele continuu sporite faţăde cadrele din AGEPI, funcţionează o reţeade instruire şi reciclare a acestora, cât şi aspecialiştilor de la întreprinderile şiinstituţiile cu care conlucrează Agenţia,cuprinzând consilierii în proprietateindustrială şi mandatarii autorizaţi. Pelângă sistemul de cursuri permanente sepractică stagieri de personal la oficiile deproprietate industrială din străinătate,participarea la seminare şi conferinţeinternaţionale.

În anul ce s-a scurs la AGEPI s-a desfăşuratactivitatea de prestare servicii – verigă deprimordială importanţă pentru asigurareaunei conlucrări fructuoase cu unităţile eco-nomice. Vom semnala pentru început patrudintre acestea, cu care AGEPI are încheiatecontracte de prestare servicii: Combinatulde panificaţie “Franzeluţa” SA (Chişinău),“Moldagrotehnica” SA şi Institutul decercetări pentru culturile de câmp (ambeledin Bălţi), firma industrial-comercială “Ti-ghina”. În total circa 100 de persoane fiziceşi juridice au apelat la serviciile AGEPIpentru consultaţii privind protecţia drep-turilor, redactarea cererilor de înregistrarea obiectelor de proprietate industrială, do-cumentarea tematică în baza literaturii debrevete şi mărci.

economici. Anterior, pe lângă bibliotecileorăşeneşti, au fost instituite patru centre deinformare în domeniul proprietăţii in-dustriale. Pe parcurs, două dintre ele (Bălţişi Cahul) au evoluat în reprezentanţe aleAGEPI. Astfel se află în curs de formare oreţea republicană de servicii informaţional-documentare în materie de proprietate in-dustrială. Sperăm ca în modul acesta săimpulsionăm, cu mijloacele specifice nouă,activitatea inovaţională în economianaţională.

Vom menţiona că în 1998 RepublicaMoldova a găzduit mai multe reuniuni,seminare şi conferinţe internaţionale despecialitate, ceea ce ne atestă eforturile îndiverse sfere de cooperare cu ţările străine,precum şi cu organizaţiile şi firmele notoriiîn protecţia proprietăţii industriale.Cooperarea internaţională ne permite să be-neficiem de importante programe deasistenţă tehnică, schimb permanent de ex-perienţă, materiale normative şi metodicede valoare fundamentală.

Pentru perioada ce urmează se contureazădouă direcţii principale de activitate aAGEPI.

proprietate industrială, de a armoniza leg-islaţia în domeniu cu cerinţele Acorduluiprivind aspectele drepturilor de proprietateindustrială legate de comerţ (TRIPs) învederea preconizatei aderări a RepubliciiMoldova la OMC. În curs de constituire,sub auspiciile AGEPI, se află CentrulNaţional de Informare şi Institutul deProprietate Industrială.

A doua. Conlucrarea eficientă cu in-stituţiile statale în vederea consolidăriicadrului administrativ şi juridic al realizăriidrepturilor de proprietate industrială(Departamentul vamal, poliţia economică,instanţele judecătoreşti specializate).Specialiştii AGEPI vor prelua din practicainternaţională şi vor propune spre aplicaremodalităţi de prevenire a delincvenţelor şisoluţionare a inevitabilelor litigii ce aparpe parcursul exploatării obiectelor de pro-prietate industrială.

În concluzie vom sublinia disponibilitateaAgenţiei de a contribui prin consolidareaşi extinderea permanentă a sistemului deprotecţie la realizarea celor mai stringenteobiective ale dezvoltării ţării noastre şiintegrării ei în economia mondializată.

Within the following pages the reader willfind a concise reflection of the activityof the State Agency on Industrial Prop-

erty Protection of the Republic of Moldova for1998, during the conditions when the intellectualproduct is going to become a defining factor in theeconomical political development of the state.

Casting a glance on the elapsed period from 1992(the foundation year of the AGEPI), we can seethat basic legislative acts on industrial propertyprotection were elaborated and adopted, a func-tional system based upon universal criteria was setup. The latter, in its turn, has imparted a new mo-tivation to the creative effort of the inventors andresearchers, offering it the advantages of joiningthe market mechanism. In the same connection,the increasing number of requirements of the eco-nomic agents denotes their interest to obtain com-petitive products on the home market and, in par-ticular, the external one.

Moreover, the AGEPI directly stimulates the cre-ativity, systematically promotes the achievementsof the inventors, including financial support forparticipation at international special exhibitions,fairs and markets. During the year under review,about 30 inventions patented in the Republic ofMoldova have been presented to the InternationalExhibition and First Inventors Olimpic Games“Genins’98” (Budapest), winning 11 medals. In1998, the AGEPI, had also exhibited an impres-sive set of inventions at the Bucharest InternationalFair. Other prestigious exhibitions were held in:Geneva, Pittsburgh, Casablanca. The InternationalExhibitions for Young People “Invention. Creativ-ity. Innovation” (in October, 1998 – IV-th edition)are yearly being displayed in Chisinau, under theauspices of the Agency.

Considering the continuously increasing exigen-cies given to the staff of the AGEPI, there is func-tioning a network of training and professional re-training thereof as well as of the experts from theenterprises and institutions the Agency is workingtogether with, including patent counsellors and at-torneys. Besides the permanent courses, study visits

по охране промышленной собственности Рес-публики Молдова в 1998 году, в условиях, ко-гда интеллектуальная продукция становится оп-ределяющим фактором в политико-экономиче-ском развитии государства.

Рассматривая период, прошедший с 1992 года(год создания AGEPI), следует констатировать,что в этот промежуток времени были раз-работаны и приняты основные законодательныеакты об охране промышленной собственности,была создана система функционирования, ос-нованная на универсальных критериях. Послед-няя, в свою очередь, вызвала новый всплеск со-зидательной активности изобретателей и иссле-дователей, предложив им преимущества рыноч-ных механизмов. Таким образом, растущее чис-ло заявок экономических агентов свиде-тельствует о заинтересованности в созданиипродукции конкурентоспособной на внутрен-нем и, особенно, на внешнем рынках.

Одновременно AGEPI непосредственно за-нимается стимулированием изобретательскойактивности, систематически продвигает дос-тижения изобретателей, предоставляя им в томчисле и финансовую поддержку для участия ввыставках, салонах и международных ярмар-ках. В отчетном году около 30 изобретений, за-патентованных в Республике Молдова, былипредставлены на Международной выставке иОлимпийских Играх изобретателей “Genius’98” (Будапешт), завоевав 11 медалей. На Меж-дународной ярмарке в Бухаресте в 1998 годуAGEPI также выставило внушительный ком-плект изобретений. Другие престижные выс-тавки состоялись в Женеве, Питтсбурге, Касаб-ланке. Под эгидой Агентства ежегодно в Ки-шинэу проводятся Международные выставкидля молодежи “Inventică, Creativitate, Inovare”(“Инвентика, созидательность, инновация”), воктябре 1998 г. – IV издание.

Принимая во внимание растущие требования ккадрам AGEPI, постоянно действует сеть обу-чения и повышения квалификации как специа-листов AGEPI, так и специалистов предприятий

at other industrial property offices, as well as par-ticipation in the international seminars and con-ferences are carried out.

The servicing activity – a highly important linkfor the profitable co-operation with the economi-cal units has been displayed during the referenceperiod with the AGEPI. First it should be men-tioned four of them, with which the AGEPI hasconcluded servicing contracts: Bakery Plant “Fra-nzeluţa”, JSC (Chisinau), JSC “Moldagrotehnica”and Field Crop Research Institute (both fromBeltsy), the industrial commercial company“Tighina”. Altogether, about 100 of legal and natu-ral persons have requested the AGEPI’s servicesand consultations related to the protection of rights,drafting of applications for the registration of in-dustrial property objects, thematic searches in thecollection of patent and trademark literature.

The AGEPI is increasingly concerned in the ex-tension of relationships with the economical agents.Previously, four information centres in the field ofindustrial property have been instituted about thecity libraries. Itinerary, two of them (Beltsy andCahul) have evolved into representations of theAGEPI. Thereby, a republican network of search –information services on industrial property is nowbeing formed. We hope, thus, to impel by meansspecifically to us, the innovation activity into thenational economy.

It should be mentioned that in 1998 the Republicof Moldova housed a number of international meet-ings, seminars and conferences in this domain, thatcertifies our efforts in diverse fields of co-opera-tion with both foreign countries and organizationsin the industrial property protection. The interna-tional co-operation enables us to benefit by im-portant programs of technical assistance, perma-nent experience exchange, normative and methodi-cal materials of fundamental value.

Two main directions of activity of the AGEPI areoutlined for the following period.

The first. To apply at the enterprises’ service acomplete information, to extend the protection toother objects of industrial property, to harmonizethe legislation in the field with the provisions of

В истекшем году в AGEPI было положено на-чало деятельности группы патентных услуг –звена первостепенной важности для обеспече-ния успешного сотрудничества с экономически-ми агентами. Для начала назовем четырех изних, с которыми AGEPI заключило договоры:хлебокомбинат “Franzeluţa” SA (Кишинэу),“Молдагротехника” SA и Исследовательскийинститут полевых культур (оба из Бэлць), про-мышленно-коммерческая фирма “Tighina”. Вобщем, около 100 физических и юридическихлиц обратились за услугами в AGEPI для полу-чения консультаций об охране прав, составле-нии заявок о регистрации объектов промышлен-ной собственности, проведении тематическихпоисков по патентной литературе и по товар-ным знакам.

AGEPI заинтересовано в растущем расширенииотношений с экономическими агентами. Ранее,на базе городских библиотек было организова-но четыре информационных центра в областипромышленной собственности. Более того, двеиз них (Бэлць и Кахул) стали представи-тельствами AGEPI. Таким образом, фор-мируется республиканская сеть поисково-ин-формационных услуг в области промышленнойсобственности. Надеемся, что таким образом спомощью новых специальных средств мы бу-дем оказывать содействие инновационной дея-тельности в национальной экономике.

Следует отметить, что в 1998 году РеспубликаМолдова провела несколько международныхсовещаний, семинаров и конференций в даннойобласти, что потребовало от нас усилий в раз-личных сферах сотрудничества с зарубежнымистранами, а также с национальными организа-циями и фирмами в области охраны промыш-ленной собственности. Международное сотруд-ничество позволяет нам пользоваться необхо-димыми программами технической помощи,нормативными и методическими материаламиогромной важности, осуществлять постоянныйобмен опытом.

the Agreement on Trade-Related Aspects of Intel-lectual Property Rights (TRIPs) with a view to thesuggested joining of the Republic of Moldova tothe WTO. The National Information Centre andthe Institute on Industrial Property Protection arenow being constituted, under the auspices of theAGEPI.

The second. The efficient co-operation with thestate institutions on the consolidation of legal andadministrative staff for the enforcement of indus-trial property rights (Customs Department, Eco-nomical Police Establishment, specialized courts).The experts of the AGEPI will take over from theinternational practice and will provide for the ap-plication modalities for delinquency prevention andsettlement of unavoidable litigations arising fromthe exploitation of industrial property objects.

In conclusion, we should underline the availabil-ity of the Agency to contribute, by permanentlyconsolidating and extending the protection system,to the accomplishment of the most urgent objec-tives for the development of our country and inte-gration thereof into the world economy.

В перспективе вырисовываются два основныхнаправления деятельности AGEPI.

Первое: предоставлять к услугам предприятийнаиболее полную информацию, расширить пе-речень охраняемых объектов промышленнойсобственности, гармонизировать законо-дательство с требованиями Соглашения по тор-говым аспектам прав интеллектуальной собст-венности (TRIPs) ввиду предстоящего присое-динения Республики Молдова к ВТО. Под эги-дой AGEPI создается Национальный центр ин-формации и Институт промышленной собст-венности.

Второе: эффективное сотрудничество с го-сударственными учреждениями в целях кон-солидации административной и юридическойсистем по осуществлению прав промышленнойсобственности (Таможенный департамент, эко-номическая полиция, специализированные су-дебные учреждения). Специалисты AGEPIпредложат для применения имеющиеся в меж-дународной практике меры по предупреж-дению правонарушений и решению неиз-бежных споров, появляющихся в процессе ис-пользования объектов промышленной соб-ственности.

В заключение, следует подчеркнуть воз-можности Агентства в содействии постояннойконсолидации и расширению системы охраныпри осуществлении самых неотложных задачразвития нашего государства и его интеграциив мировую экономику.

Multiplele activităţi desfăşurate deAGEPI în 1998 s-au axat pe pro-movarea politicii unice în do-

meniul protecţiei proprietăţii industriale.Chintesenţa acestei politici a constat încrearea unor condiţii favorabile pentrustimularea inventicii şi eficientizareasistemului de protecţie a obiectelor deproprietate industrială. Au fost elaboratedocumentele necesare şi a fost obţinutălicenţa de stat privind organizarea în cadrulAgenţiei a Institutului de ProprietateIndustrială care va fi transformat ulteriorîn Centru regional de pregătire a spe-cialiştilor şi de propagare a cunoştinţelorîn domeniul protecţiei proprietăţii in-dustriale. De asemenea, au fost elaborateactele normative ce ţin de antrenarea maiactivă a obiectelor de proprietate industrialăîn circuitul economic. În acest sensmenţionăm materialele privind evaluareaproprietăţii industriale, orientarea business-strategiei activităţii de antreprenoriat înaplicarea rezultatelor elaborărilor inov-aţionale, materiale care au fost expediatespre examinare Guvernului.

Au fost întreprinse un şir de măsuri menitesă perfecţioneze sistemul de brevetare încondiţiile economiei de piaţă, între acesteafiind optimizarea actelor legislative şi nor-mative în vigoare în domeniul proprietăţiiindustriale, diversificarea metodelor de

colaborare cu inventatorii şi titularii,lansarea unor propuneri concrete privindstimularea proceselor de implementare ainvenţiilor.

În legătură cu pregătirile pentru aderareaRepublicii Moldova la Organizaţia Mon-dială de Comerţ au fost depuse eforturi sub-stanţiale în vederea armonizării legislaţieinaţionale conform cerinţelor AcorduluiTRIPs. Au continuat lucrările de compu-terizare şi automatizare a proceselor teh-nologice informaţionale, soldate cu fonda-rea reţelei proprii AGEPINET, bază pentrugenerarea paginii INTERNET; a fost efec-tuat transferul de informaţii de pe hârtiepe suport electronic; au fost elaborate şilansate trei discuri CD-ROM care cores-pund standardelor internaţionale; au fostprezentate materialele solicitate pentru lan-sarea unui CD-ROM comun al ţărilor CSI;a fost asigurat accesul la baza de dateEPIDOS-INPADOC a Oficiului Europeande Brevete (OEB). Concomitent a continuatdezvoltarea şi modernizarea structuriiAgenţiei. În scopul sporirii eficienţei mun-cii, reducerii termenelor de pregătire şi edi-tare a publicaţiilor oficiale ale AGEPI, pre-cum şi al reducerii timpului şi cheltuielilorpentru desfăşurarea proceselor interne deredactare-editare, în cadrul Agenţiei a fostcreată o nouă subdiviziune a Depar-tamentului informaţional – Secţia Editura.

The multiple activities carried out by the AGEPIin 1998 have been focused on the promotion ofa unique policy in the field of industrial property

protection. The quintessence of this policy consisted inthe creation of certain favourable conditions for stimu-lation of inventiveness and for making more efficientthe protection system of the industrial property objects.The required documents have been elaborated and therehas been obtained a state license regarding the organi-zation within the AGEPI of the Institute on IndustrialProperty Protection, which will subsequently be trans-formed into a regional Centre for training of experts andpropagation of knowledge in the field of industrial prop-erty protection. Normative acts concerning stimulationof industrial property objects into the economic circula-tion have also been elaborated. We can, herein, mentionthe materials on the evaluation of industrial property,orientation of business strategy to the entrepreneurialactivity in the application of innovatory elaborationsresults, materials that were transmitted to the Govern-ment for examination.

A lot of measures provided for the improvement of patentsystem in the market economy conditions have beenundertaken, among them being optimization of validnormative and legislative acts in the industrial propertyfield, diversification of methods of co-operation withthe inventors and owners, launching of certain concreteproposals on stimulation of processes for the implemen-tation of inventions.

In connection with the preparations for joining of theRepublic of Moldova to the World Trade Organization,considerable efforts have been made for the harmonizati-on of national legislation preceeding from the require-ments of the TRIPs Agreement. There have been conti-nued works on computerization of informational techno-logical processes, that ended in the foundation of theAGEPINET own system, a ground for the generation ofINTERNET page; the transfer of information from pa-per on electronic carriers has been performed; three CD-ROM disks have been elaborated and launched accor-ding to the international standards; materials requiredfor launching of a common CD-ROM for CIS countries;access to the EPIDOS-INPADOC database of the Euro-pean Patent Office (EPO) has been provided. Concomi-tantly, development and modernization of the organizati-onal structure of the AGEPI have been continued. Inorder to increase the efficiency of works, to reduce thetime limits of preparation and publication of the AGEPIofficial issues, as well as to reduce the time limits andcosts for carrying on the internal elaboration-publicationprocesses, a new subdivision of Information Department –the editorial one, has been created within the AGEPI.

Многосторонняя деятельность AGEPI в 1998году была направлена на осуществлениеединой политики в области охраны про-

мышленной собственности. Квинтэссенцией этойполитики является создание благоприятных условийдля стимулирования изобретательства и повышенияэффективности системы охраны объектов промыш-ленной собственности. Были разработаны необхо-димые материалы и получена государственная ли-цензия на организацию в рамках AGEPI Институтапромышленной собственности, который впоследст-вии будет преобразован в Региональный центр подго-товки специалистов и распространения знаний в об-ласти охраны промышленной собственности. Кро-ме того были разработаны нормативные акты, спо-собствующие более активному внедрению объектовпромышленной собственности в экономическуюсистему. На рассмотрение Правительства представ-лен пакет нормативно-законодательных актов пооценке и учету объектов промышленной собствен-ности. Его утверждение будет способствовать инно-вационной направленности бизнес-стратегии пред-принимательской деятельности.Был осуществлен ряд мер, направленных на повы-шение эффективности функционирования патентнойсистемы в условиях рыночной экономики, средикоторых следует назвать оптимизацию действующихзаконодательных и нормативных актов в областипромышленной собственности, введение новыхформ сотрудничества с изобретателями и вла-дельцами охранных документов, разработку кон-кретных предложений по стимулированию про-цессов внедрения изобретений.

В связи с подготовкой к вступлению РеспубликиМолдова во Всемирную Торговую Организацию былосуществлен ряд действий по приведению нацио-нального законодательства в соответствие с требо-ваниями Соглашения TRIPs. Были продолжены рабо-ты по компьютеризации и автоматизации информа-ционно-технологических процессов, завершившие-ся созданием внутриведомственной сети AGEPI-NET- базы для создания страницы INTERNET. Былосуществлен перевод информации с бумажного но-сителя на электронный; выпущены три диска CD-ROM, соответствующие международным стандар-там; представлены материалы для выпуска единогодиска CD-ROM стран СНГ; обеспечен доступ к базеданных EPIDOS-INPADOC Европейского патентно-го ведомства (ЕПВ). Одновременно продолжалосьразвитие и модернизация структуры AGEPI. AGEPI îşi desfăşoară activitatea ca organguvernamental de specialitate cu autoritateunică pe teritoriul Republicii Moldova înasigurarea protecţiei proprietăţii industrialeîn conformitate cu legislaţia naţională îndomeniu şi cu prevederile convenţiilor şitratatelor internaţionale la care RepublicaMoldova este parte.

Agenţia elaborează şi prezintă spre apro-bare Guvernului strategia dezvoltării pro-tecţiei proprietăţii industriale în RepublicaMoldova şi aplică politica în domeniu.

Atribuţiile specifice ale AGEPI pentru re-alizarea obiectului său de activitate sunt:

n organizează şi gestionează sistemul deprotecţie a proprietăţii industriale înconformitate cu legislaţia RepubliciiMoldova şi acordurile internaţionale lacare Republica Moldova este parte, eli-berează în numele statului titluri de pro-tecţie;

n recepţionează şi supune examinăriicererile privind eliberarea titlurilor deprotecţie pentru obiectele de proprietateindustrială;

n editează, publică şi comercializeazădescrierile brevetelor de invenţie;

n organizează instruirea şi reciclarea cad-relor în domeniul proprietăţii industriale;

n organizează activitatea Comisiei deApel pentru examinarea contestaţiilorce ţin de protecţia proprietăţii indus-triale;

n controlează corectitudinea calculelor deevaluare a proprietăţii industriale laîntreprinderi şi organizaţii;

n elaborează, realizează şi coordoneazăprograme de dezvoltare şi cooperare cualte ţări sau organizaţii internaţionale îndomeniu;

n elaborează şi realizează programe deimplementare şi comercializare aproprietăţii industriale, stimulare aactivităţii tehnico-ştiinţifice.

Pentru îndeplinirea atribuţiilor enumerateîn cadrul Agenţiei au fost create sub-diviziuni corespunzătoare, conform or-ganigramei (pag. 11).

The AGEPI carries on its activity as a special state bodyhaving the unique authority on the territory of the Re-public of Moldova of providing protection to the indus-trial property in accordance with the national legisla-tion thereto and the provisions of the international con-ventions and treaties to which the Republic of Moldovais party.

The Agency elaborates and submits for approval to theGovernment the development strategy of the industrialproperty protection in the Republic of Moldova andapplies the policy thereto.

The essential functions of the AGEPI for the accom-plishment of its object of activity are the following:n organizes and administrates the industrial property

protection system in accordance with the legislationof the Republic of Moldova and international agree-ments to which the Republic of Moldova is party,grants on behalf of the state titles of protection;

n receives and examines applications for the grant ofa title of protection for the industrial property ob-jects;

n issues, publishes and markets the descriptions ofpatents for an invention;

n organizes training and professional re-training of thestaff in the industrial property field;

n elaborates proposals for the improvement of the in-dustrial property protection system and checks theimplementation and observance of legislationthereto;

n examines and registers license or cession agreementsabout rights on the industrial property objects;

n organizes the Appeals Board activity for the exami-nation of appeals relating to the industrial propertyprotection;

n checks the correctness on the evaluation of indus-trial property at enterprises and organizations;

n elaborates, implements and co-ordinates programswith other countries or international organizationsin this field;

n elaborates and realizes programs on the implemen-tation and marketing of the industrial property, stimu-lation of technical and scientific activity.

For the fulfilment of tasks enumerated within the Agencyadequate subdivisions have been created proceedingfrom the organization chart (p. 11).

AGEPI осуществляет свою деятельность в качествеспециализированного правительственного органа,обеспечивающего на территории Республики Мол-дова охрану промышленной собственности в соот-ветствии с национальным законодательством в об-ласти и с положениями международных конвенцийи договоров, участницей которых является Рес-публика Молдова.

Агентство разрабатывает и представляет на утверж-дение Правительству стратегию развития охраныпромышленной собственности в Республике Мол-дова и осуществляет политику в данной области.Основные функции, которые выполняет AGEPI дляосуществления своей деятельности:n организует и управляет системой охраны про-мышленной собственности в соответствии с за-конодательством Республики Молдова и между-народными соглашениями, участницей которыхявляется Республика Молдова, выдает охранныедокументы от имени государства;

n получает заявки и проводит их экспертизу с це-лью выдачи охранных документов на объектыпромышленной собственности;

n издает, публикует и реализует описания изо-бретений;

n организует обучение и совершенствование кад-ров в области охраны промышленной соб-ственности;

n разрабатывает предложения по совершенст-вованию системы охраны промышленной соб-ственности и осуществляет контроль над вы-полнением и соблюдением законодательства вданной области;

n рассматривает и регистрирует лицензионные до-говоры или договоры по переуступке прав на объ-екты промышленной собственности;

n организует деятельность Апелляционной Ко-миссии по рассмотрению возражений, касаю-щихся охраны промышленной собственности;

n проверяет правильность расчетов по оценке про-мышленной собственности на предприятиях и ворганизациях;

n разрабатывает, осуществляет и координируетпрограммы развития связей и взаимодействия сдругими странами или международными ор-ганизациями в данной области;

n разрабатывает и осуществляет программы реа-лизации и коммерциализации промышленнойсобственности, стимулирует научно-техниче-скую деятельность.

Для выполнения перечисленных функций в рамкахAGEPI созданы соответствующие подразделения,представленные на схеме (с. 11).

În 1998 secţia examinare invenţii şi modele de utilitate a fost divizată în 5 grupe tematice de examinare:n biologie, medicină, medicină veterinară;n electronică, electrotehnică, automatică, fizică, telecomunicaţii, energetică;n construcţii de maşini, metalurgie, construcţii, transport;n industrie uşoară, agricultură, industrie alimentară;n chimie, farmacieşi un grup de statistică, eliberare acte, deservire tehnică.

În 1998 au fost depuse 271 de cereri de brevet de invenţie (în 1997 – 347). Numărul cererilor de brevet deinvenţie în comparaţie cu anul precedent s-a redus cu 21,8%. Solicitanţii naţionali au depus 257 de cereri(în 1997 – 295), iar solicitanţii străini 14 cereri (în 1997 – 52), 10 dintre ele sunt cereri PCT. Numărulcererilor depuse de solicitanţii naţionali s-a redus cu 12,9% în comparaţie cu anul precedent, iar numărulcererilor depuse de solicitanţii străini s-a redus cu 73,1%.

În perioada de referinţă au fost adoptate 241 de hotărâri de acordare a brevetelor de invenţie (în 1997 – 246)şi au fost eliberate 202 brevete de invenţie (în 1997 – 225), inclusiv 60,9% – pe răspunderea solicitanţilor;26,7% – cu examinare în fond; 9,9% – în baza certificatelor de autor şi 2,5% – pentru soiuri de plante. Înraport cu anul precedent numărul brevetelor de invenţie eliberate s-a redus cu 10,2%. Solicitanţilor naţionalile-au fost eliberate 180 de brevete de invenţie (în 1997 – 210), iar solicitanţilor străini 22 de brevete deinvenţie (în 1997 – 15). Repartiţia brevetelor de invenţie pe domenii este în ansamblu următoarea:n necesităţi curente ale vieţii 50%;n chimie 25,7%;n fizică 8,4%;n tehnici industriale diverse 5,9%;n electricitate 5%;n mecanică 4%;n textile 1%.

În 1998 persoanelor fizice şi juridice din 9 ţări le-au fost eliberate brevete de invenţie conform secţiunilorCIB. Solicitanţii străini au brevetat invenţii din domeniile medicinei, farmacologiei, construcţiei de maşini-unelte, chimiei organice şi anorganice, fibrelor naturale şi sintetice.

Din 180 de brevete de invenţie eliberate solicitanţilor naţionali 101 (57%) au fost eliberate pe răspundereasolicitanţilor, 79 (43%) – cu examinare în fond, inclusiv în baza certificatelor de autor – 21 (11%).

Din cele 22 de brevete de invenţie eliberate solicitanţilor străini 14 (60%) au fost eliberate pe răspundereasolicitanţilor, iar 8 (40%) – cu examinare în fond.

În tabelele 1–2 şi în figura 1 este prezentată repartiţia brevetelor eliberate de AGEPI în 1998 conformClasificării Internaţionale de Brevete (CIB), după ţara de rezidenţă a titularului şi după domeniile tehnice.

Cele mai considerabile realizări în domeniul brevetării invenţiilor au fost obţinute de:n Universitatea de Stat din Moldova 24 de brevete;n Universitatea de Stat de Medicină şi Farmacie 18;n Institutul de Fiziologie a Plantelor al AŞRM 9;n Institutul de Cercetări Ştiinţifice “ELIRI” 8;n Institutul Naţional al Viei şi Vinului 4.

In 1998, the Inventions and Utility Models Exami-nation Division – was divided into five thematicsubdivisions:

n biology, medicine, veterinary medicine;n electronics, electrical engineering, automation,

physics, telecommunications, energetics;

n mechanical engineering, metallurgy, construc-tions, transport;

n light industry, agriculture, food industry;n chemistry, pharmacology;

and a group for statistics, granting of acts, servic-ing.

In 1998, 271 of patent applications for inventionshave been filed (in 1997 – 347). The number ofpatent applications for inventions in comparisonwith the last year has decreased with 21,8%. Thenational applicants have filed 257 of applications(in 1997 – 295) and the foreign applicants – 14applications (in 1997 – 52), 10 of them constitutethe PCT applications. The number of applicationsfiled by the national applicants has decreased with12,9% in comparison with the last year and thenumber of applications filed by foreign applicantshas decreased with 73,1%.

Brevete euroasiatice

În 1998 au fost depuse 1085 de cereri de brevet de invenţie euroasiatice, inclusiv 967 de cereri PCT pentrucare s-a deschis faza naţională.

Numărul brevetelor euroasiatice valabile pe teritoriul Republicii Moldova la finele anului 1998 a fost de158, inclusiv 28 după achitarea primei taxe de menţinere în vigoare.

Modele de utilitateActualmente rolul modelelor de utilitate în formarea pieţei obiectelor de proprietate industrială este nee-senţial din cauza numărului redus de cereri depuse şi certificate eliberate. De exemplu, în 1998 au fostdepuse 6 cereri de înregistrare a modelelor de utilitate (în 1997 – 5) şi au fost eliberate 3 certificate.Fenomenul respectiv se explică prin insuficienta conştientizare a importanţei şi avantajelor protecţieiacestui obiect de proprietate industrială.

Desene [i modele industrialeÎn 1998 la AGEPI au fost depuse 547 de cereri de înregistrare a desenelor şi modelelor industriale, inclusiv65 pe cale naţională şi 482 pe cale internaţională (conform Aranjamentului de la Haga).

Având în vedere că legislaţia Republicii Moldova prevede posibilitatea depunerii cererilor cu depozitemultiple, în tabelul 3 sunt prezentate datele privind numărul de cereri depuse în Republica Moldova şinumărul de desene şi modele industriale solicitate.

Faţă de anul 1997 numărul total de cereri depuse în 1998 a sporit cu 20%, iar numărul total de desene şimodele industriale s-a majorat cu 43,3%. Deşi numărul de cereri depuse de solicitanţii naţionali în 1998s-a redus, numărul efectiv al desenelor şi modelelor industriale pentru care s-au depus aceste cereri a crescut.Aceasta se explică prin faptul că solicitanţii au început să profite de avantajele depozitelor multiple.

Solicitanţii străini deţin întâietatea după numărul total de cereri depuse, depăşind de şase-şapte ori numărulde cereri ale solicitanţilor naţionali.

În 1998 au fost înregistrate 519 cereri conform Aranjamentului de la Haga care conţin 3052 de desene şimodele industriale, au fost eliberate 60 de certificate de înregistrare care conţin 187 de desene şi modele

In 1998 natural and legal persons from 9 countrieswere granted patents for invention according to theIPC sections. Foreign owners have patented inven-tions from medicine, pharmacology, mechanicalengineering, organic and inorganic chemistry, natu-ral and synthetic fibers.

From the total amount of 180 of patents issued tonational owners, 101 (57%) have been granted atthe responsibility of the applicants, 79 (43%) un-der a substantive examination, 21 (11%) under aninventor’s certificate.

From those 22 patents issued to foreign owners,14 (60%) have been granted at the responsibilityof the applicants and 8 (40%) under a substantiveexamination.

Distribution of patents granted by the AGEPI in1998 according to the International Patent Classi-fication (IPC) under the country of residence ofthe patent owner and under technical domains isrepresented in Tables 1–2 and in Fig. 1.

The most considerable accomplishments in thefield of inventions patentability have been obtainedby the:

n State University of the Republicof Moldova 24 patents;

n State University of Medicineand Pharmacy 18;

n ASM Plant Physiology Institute 9;

n “ELIRI” Research Institute 8;

n Vine and Wine National Institute 4.

The analysis of patenting dynamics under nationalprocedure shows a decreasing of the number offiled applications and granted patents in 1998 incomparison with the last year. However, taking intoaccount the possibility of obtaining the protectionunder the regional procedure via Eurasian PatentOffice and being guided by the statistic data men-tioned below we can ascertain the stability of in-

n Государственный медицинско-фармацевтический университет 18;

n Институт физиологиирастений АН 9;

n Институт научныхисследований “ELIRI” 8;

n Национальный институтвинограда и вина 4.

Анализ динамики патентования изобретений понациональному пути показывает снижение в1998 г. числа поданных заявок и выданных патен-тов по сравнению с предыдущим годом. Однако,учитывая возможность получения охраны по ре-гиональному пути - через Евразийское патентное

Repartiţia cererilor înregistrate în 1998 conform Aranjamentului de la Haga este prezentată în tabelul 4.

Întâietatea în depunerea cererilor revine solicitanţilor din Elveţia, Germania şi Franţa.

Analizând domeniile la care se referă cererile de înregistrare a desenelor şi modelelor industriale, constatămcă solicitanţii străini preferă anumite clase (tabelul 5).

Cererile depuse de solicitanţii naţionali atestă preferinţa pentru desenele şi modelele industriale din claseleprezentate în tabelul 6.

Eurasian Patents

1085 of eurasian patent applications have been filedin 1998, including 967 of PCT applications forwhich the national phase has been opened.

The number of eurasian patents valid on the terri-tory of the Republic of Moldova at the end of 1998amounted to 158, including, 28 after payment offirst maintenance fee.

Utility Models

At present, the role of utility models in the forma-tion of industrial property market is not importantbecause of the reduced number of filed applica-tions and granted certificates. For example, 6 appli-cations for the registration of utility models havebeen filed (in 1997 – 5) and 3 certificates have beengranted in 1998. The said phenomenon is caused bythe insufficient awareness of the importance andadvantages of this industrial property object.

Industrial designs

547 of applications for the registration of indus-trial designs have been filed with the AGEPI in1998, 65 of them have been filed under nationalprocedure and 482 under international procedure(under the Hague Agreement).

Taking into consideration the fact that the legisla-tion of the Republic of Moldova provides for thepossibility of filing applications covering multipledeposits, in Table 3 there are presented data con-cerning the number of applications filed in theRepublic of Moldova and the number of requestedindustrial designs.

The total number of the applications filed in 1998has increased with 20% in comparison with 1997and the total number of the industrial designs hasincreased with 43,3%. Though, the amount of na-tional applications in 1998 has been reduced a littlehowever, the effective amount of industrial designsfor which have been filed these applications hasincreased. This denotes that the applicants beganto benefit of the advantage of multiple deposits.

The foreign applicants maintain the leadership inthe total number of filed applications. As well as

Число евразийских патентов, действующих натерритории Республики Молдова по состояниюна 1 января 1999 года, составило 158, включая 28после оплаты первой пошлины за поддержание всиле.

В настоящее время роль полезных моделей в фор-мировании рынка промышленной собственностине является основной, вследствие небольшогочисла заявок и выданных свидетельств. В 1998году было подано 6 заявок на регистрацию по-лезных моделей (в 1997 г. – 5) и выдано 3 свиде-тельства. Этот феномен объясняется тем, что ещенедостаточно осознана важность и преимущест-ва охраны этого объекта промышленной собст-венности.

Общее количество поданных в AGEPI заявок нарегистрацию промышленных рисунков и моделейв 1998 году составило 547, из которых 65 – на-циональных и 482 – международных (по Гаагско-му Соглашению).

В связи с тем, что национальное законодательст-во предусматривает возможность подачи много-видовой заявки, в таблице 3 приведены сведенияо поданных в Республику Молдова заявках и околичестве заявленных на регистрацию промыш-ленных рисунков и моделей.

По сравнению с 1997 годом общее число подан-ных в 1998 году заявок увеличилось на 20%, аобщее количество промышленных рисунков имоделей увеличилось на 43,3%. При этом числоподанных национальных заявок снизилось, хотяобщее число промышленных рисунков и моделей,на которые были поданы эти заявки, возросло.Это объясняется тем, что заявители стали актив-

Este relevant interesul sporit al solicitanţilor naţionali şi străini pentru protecţia desenelor şi modelelorindustriale din clasele referitoare la designul mobilierului şi al sticlelor.

Pe parcursul anului au fost depuse 10 (în 1997 – 3) cereri de înregistrare a denumirilor de origine aproduselor. Datele statistice prezentate în tabelul 7 reflectă structura cererilor de înregistrare a mărcilor şia denumirilor de origine a produselor depuse şi examinate în 1998 comparativ cu 1997.

Din totalul cererilor de înregistrare a mărcilor, depuse pe cale naţională, în afară de Moldova, mareamajoritate provin, după cum relevă tabelul 8 şi figura 2, din SUA, Marea Britanie, Germania, Bulgaria,companiile din aceste ţări fiind cele care au manifestat şi în anul de bilanţ cel mai mare interes pentruprotejarea activităţii lor comerciale în Republica Moldova.

in 1997, the creative spirit thereof in 1998 has in-creased by six-seven times in comparison with thenational applicants one.

519 of applications have been registered in 1998under the Hague Agreement, including 3052 ofindustrial designs, 60 certificates of registrationhave been granted including 187 of industrial de-signs. From those 60 certificates for the registra-tion of industrial designs 49 have been granted tothe national applicants and 11 to the foreign ones,5 of them from the USA, 3 from Great Britain, 1from the Republic of Korea, 1 from Bulgaria and1 from Finland.

The distribution of applications registered in 1998according to the Hague Agreement is shown inTable 4.

The leadership in the application filing is held bythe of foreign applicants from Switzerland, Ger-many and France.

Having analysed the domains to which the appli-cations for the registration of industrial designsrefer, we can ascertain the fact that the foreignapplicants prefer certain classes (Table 5).

The applications filed by the national applicantsdenote their preferance to industrial designs fromclasses shown in Table 6.

It is relevant the increased interest of national andforeign applicants in the protection of industrialdesigns from classes relating to the furniture andglasses design.

Trademarks

During the year under review the number of appli-cations for the registration of trademarks filed withthe AGEPI amounted to 916 (in 1997 – 1380). 328applications have been filed by national applicants(in1997 – 861) and 588 have been filed by the for-eign applicants (in 1997 – 519).

This year 10 applications for the registration ofappellations of origin of goods have been filed (in1997 – 3). The statistical data represented in Table7 reflect trademarks and appellations of origin ofgoods filed and examined in 1998 in comparisonwith 1997.

From the total number of the applications for theregistration of trademarks, except Moldova, most

Из 60 сви-детельств о регистрации промышленных рисун-ков и моделей национальным заявителям выда-но 49 и иностранным – 11, среди которых: US(5),GB(3), KR(1), BG(1) и FI(1).

Распределение международных регистраций в1998 году по странам подачи представлено в таб-лице 4.

При анализе регистраций зарубежных стран вРеспублике Молдова видно, что лидерами по ко-личеству регистраций продолжают оставатьсяШвейцария, Германия и Франция.

Анализ регистрируемых в Республике Молдовапромышленных рисунков и моделей по отраслямпоказывает, что приоритетными являются направ-ления, указанные в таблице 5.

Классы, наиболее часто указываемые националь-ными заявителями, представлены в таблице 6.

Наблюдается пересечение интересов националь-ных и иностранных заявителей к охране предме-тов меблировки и бутылок.

Anul 1998 s-a remarcat, îndeosebi,prin definitivarea cadrului juridic,perfecţionarea procedurilor de exa-

minare şi acordare a protecţiei obiectelor deproprietate industrială. De menţionat înacest context elaborarea proiectelor de legiprivind modelele de utilitate şi topografiilecircuitelor integrate. De asemenea, AGEPIa propus spre aprobare Guvernului unproiect de modificare a Codului cu privirela contravenţiile administrative şi un proiectde modificare a Legii cu privire la întrepr-inderi şi antreprenoriat, ultimul având cascop excluderea divergenţelor posibiledintre titularii denumirilor de firmă şititularii mărcilor înregistrate. Considerabila fost aportul la implementarea AcorduluiTRIPs. În activitatea de armonizare a leg-islaţiei Republicii Moldova cu cerinţeleAcordului TRIPs au fost antrenate activ şiorganele vamale, procuratura, poliţiaeconomică, instanţele judecătoreşti. De-partamentului Vamal i-au fost prezentate oserie de propuneri privind adoptarea unormăsuri de asigurare a protecţiei proprietăţiiindustriale la frontieră, iar Guvernului i s-apropus instituirea unui grup special decoordonare în vederea implementării

Examinarea detaliată a prevederilor Acor-durilor şi Convenţiilor la care RepublicaMoldova este parte a facilitat revizuirea unorproceduri şi, în consecinţă, aplicarea mai efi-cientă a legislaţiei în vigoare. Astfel, a fostdefinitivată procedura de examinare şi în-registrare a contractelor de franchising, afost examinată procedura admiterii scriso-rilor de acord la înregistrarea semnelor si-milare sau asemănătoare cu mărcile înregis-trate, a fost elaborat proiectul model al Sta-tutului mărcii colective de produs şi/sau deserviciu.

Din 1994 până în prezent la Comisia de Apelau fost depuse 90 de contestaţii (fig. 4),dintre care 16 au fost satisfăcute parţial sauintegral, 51 au fost respinse din diferite mo-tive, în conformitate cu prevederile legisl-aţiei în vigoare, 4 contestaţii au fost retrase,iar 5 contestaţii au fost remise spre re-examinare. 14 contestaţii neexaminate în1998 vor fi examinate în 1999. Şapte dosarede contestaţie din numărul celor respinse aufost puse pe rol la Judecătoria Economică aRepublicii Moldova.

В 1998 году следует особенно выделитьработу по формированию правовой сис-темы, совершенствованию процедур

экспертизы и предоставления охраны объектампромышленной собственности. В этом кон-тексте можно упомянуть проекты законов о по-лезных моделях и о топографии интегральныхмикросхем. AGEPI предложило на утверждениеПравительству проект изменений Кодекса обадминистративных нарушениях и проект изме-нений Закона о предприятиях и предпри-нимательстве, целью последнего является ис-ключение возможных разногласий между вла-дельцами фирменных наименований и владель-цами зарегистрированных товарных знаков.Важным событием в юридической деятельно-сти AGEPI явилось выполнение комплекса ра-бот, связанных с приведением национальногозаконодательства в области охраны промыш-ленной собственности в соответствие с требо-ваниями Соглашения ТRIPs, одного из основ-ных правовых документов, определяющих пра-вовой механизм деятельности Всемирной тор-говой организации (ВТО). К работе по гармо-низации законодательства были привлечены та-моженные органы, прокуратура, экономическаяполиция, судебные органы. Таможенномудепартаменту был представлен ряд пред-ложений по мерам обеспечения охраны про-мышленной собственности на границе. В Пра-вительство было направлено предложение осоздании специальной группы, координи-рующей выполнение требований СоглашенияTRIPs, в свете присоединения Республики Мол-дова к ВТО.

Тщательное изучение положений международ-ных соглашений и конвенций, участницей ко-торых является Республика Молдова, дало воз-можность пересмотреть некоторые ведомствен-ные юридические процедуры с целью повыше-ния эффективности применения действующегозаконодательства. В частности, была отработа-на процедура рассмотрения и регистрации до-

The year 1998 is remarkable, especially, fordefinitization of judicial system, improve-ment of granting and examination proce-

dures for the protection of industrial property ob-jects. It should be mentioned, herein, elaborationof Law on Utility Models and Law on Topogra-phies of Integrated Circuits. The AGEPI has alsoprovided for the approval of Government a projectfor the modification of the Code concerning theadministrative minor offenses and a project for themodification of the Law regarding enterprises andfree enterprise, the latter having as purpose exclu-sion of possible divergences between the ownersof firm names and owners of registered marks. Animportant event in the judicial activity of theAGEPI constituted the realization of several worksrelated to the implementation of national legisla-tion in the filed of the industrial property protec-tion according to the provisions of the TRIPsAgreement, one of the main legal documents, de-termining the legal mechanism of the World TradeOrganization (WTO) activity. To the work concern-ing the harmonization of the legislation were im-plied Customs Authorities, Prosecutor’s Office,economical police establishment, Courts. Herein,a series of proposals have been furnished to theCustoms Department concerning adoption of cer-tain measures ensuring the industrial property pro-tection at border. A proposal for the institution ofa special group coordinating the implementationof TRIPs Agreement provisions was submited tothe Government, with a view of joining of the Re-public of Moldova to the WTO.

The detailed examination of the provisions of theAgreements and Conventions to which the Repub-lic of Moldova is party, facilitated revision of cer-tain procedures and, consequently, efficient appli-cation of the legislation in force. Thus, it has beenfinalized the procedure for registration and exami-nation of franchising agreements, it has been ex-amined the procedure of receiving agreement let-ters to the registration of signs identical or similarto the registered marks, it has been elaborated a

draft model to the collective trade and/or servicemarks status.

Since 1994 to 1998 respectively, 90 appeals havebeen filed with the Appeals Board (Fig.4), 16 ofwhich have been satisfied completely or partly, theother 51 have not been satisfied on different rea-sons under provisions of the legislation in force, 4appeals have been withdrawn, one because of non –compliance with the requirements of the Regula-tion on the Appeals Board of the AGEPI and 5appeals have been delivered for reexamination. Theremained 14 appeals will be examined in 1999.Seven appeal files from the amount of those un-satisfied have been transmitted to the EconomicCourt of the Republic of Moldova.

Una dintre direcţiile prioritare aleactivităţii Agenţiei de Stat pentruProtecţia Proprietăţii Industriale

este orientată spre afirmarea RepubliciiMoldova pe arena mondială. Fiind aliniatăla normele dreptului internaţional, Repub-lica Moldova a aderat la convenţiile,aranjamentele şi tratatele internaţionale îndomeniul protecţiei proprietăţii industriale.În 1998 AGEPI şi-a continuat activitateapermanentă pentru onorarea obligaţiilorconforme convenţiilor, aranjamentelor şitratatelor în calitate de reprezentant oficialal Republicii Moldova.

Republica Moldova este parte la 15 tratate,convenţii şi aranjamente internaţionale îndomeniul protecţiei proprietăţ ii in-dustriale. La 1 septembrie 1998 a intrat învigoare Aranjamentul de la Strasbourgprivind Clasificarea internaţională debrevete, iar la 28 septembrie 1998 Repub-lica Moldova a aderat la Convenţia

Internaţională privind Protecţia Re-alizărilor în Selecţie.

Astfel, aderarea la tratatele, convenţiile şiaranjamentele internaţionale în vigoare îndomeniul proprietăţii industriale şi ra-tificarea acestora se apropie de final.

Participarea la acestea antrenează Republi-ca Moldova în sistemul mondial de pro-tecţie a proprietăţii industriale, favorizeazădezvoltarea propriului sistem de protecţie,facilitează armonizarea legislaţiei naţionalecu cea a altor state, oferă acces la reuniunimondiale, conferinţe, expoziţii, simpozioa-ne internaţionale de specialitate, creând înacelaşi timp multiple posibilităţi pentru co-operarea internaţională şi regională în do-meniu.

Activitatea internaţională a AGEPI s-adesfăşurat în contextul general al sistemuluiinternaţional de protecţie a proprietăţiiindustriale.

Sunt relevante participarea AGEPI la sesi-unile Organizaţiei Mondiale de ProprietateIntelectuală (OMPI) şi extinderea relaţiilorde cooperare în cadrul diverselor programelansate de prestigioasa organizaţie des-tinate ţărilor în curs de dezvoltare.

Reprezentanţii Republicii Moldova au par-ticipat la lucrările sesiunilor ordinare, ex-traordinare şi speciale de diferite niveluriorganizate de OMPI în cadrul Uniunilor In-ternaţionale şi Comitetelor Permanente.Colaboratorii AGEPI au participat la reu-niunile Comitetelor Permanente şi ale gru-pelor de lucru OMPI, ale căror atribuţiiconstau în soluţionarea problemelor de pro-cedură, distribuţie, standardizare şi man-agement în domeniul informaţiei debrevete; au acordat o deosebită atenţieproblemelor ce ţin de elaborarea Tratatului

privind Legislaţia în Domeniul Brevetelor(PLT); şi-au adus aportul la desfăşurareaîntrunirilor privind mărcile notorii şi altoracţiuni organizate de OMPI.

OMPI acordă asistenţă permanentă în pe-rfecţionarea specialiştilor, în organizareaseminarelor, simpozioanelor, conferinţelorregionale.

Prevederile Acordului TRIPs privind pr-otecţia mărcilor şi indicaţiilor geografice,realizarea drepturilor de proprietateindustrială şi combaterea contrafacerii încazul mărcilor de fabrică, de comerţ şi deservicii prin prisma experienţei pro-ducătorilor, combaterea pirateriei, roluldepartamentelor vamale în realizareadrepturilor de proprietate intelectuală,drepturile de autor şi drepturile conexe încontextul Acordului TRIPs – acestea au

One of the priority directions of the StateAgency on Industrial Property Protectionactivity is oriented to the assertion of the

Republic of Moldova on the worldwide arena.Being aligned with the international law standards,the Republic of Moldova joined international con-ventions, agreements and treaties on industrial pro-perty protection. In 1998 the AGEPI continued itspermanent activity with the fulfilment of these con-ventions, agreements and treaties obligations as anofficial representative of the Republic of Moldova.

The Republic of Moldova is party to 15 interna-tional treaties, conventions and agreements on in-dustrial property protection. On September 1, 1998,the Strasbourg Agreement concerning the Interna-tional Patent Classification came into force and onSeptember 28, 1998, the Republic of Moldovajoined the International Convention for the Pro-tection of New Varieties of Plants.

Thus, joining to the international treaties, conven-tions and agreements in the field of industrial prop-erty protection and ratification thereof is drawingto a close.

Participation in them integrates the Republic ofMoldova into the world system of industrial prop-erty protection, promotes development of the itsown national system of protection facilitates theharmonization of national legislation with that ofother states, gives the right to participate in theworks of international meetings, conferences, ex-hibitions, special symposiums, creating at the sametime multiple possibilities for regional and inter-national cooperation in this field.

The international activity of the AGEPI has beenconducted on in the general context of the interna-tional system for the protection of industrial prop-erty.

World Intellectual PropertyOrganization (WIPO)

Herein, there are relevant the AGEPI participationin the World Intellectual Property Organization(WIPO) activity and extention of cooperation re-lations within various Programs launched by WIPOand provided for developing countries.

О дним из приоритетных направленийдеятельности AGEPI является утвержде-ние Республики Молдова на мировой аре-

не. Приняв нормы международного права, Рес-публика Молдова присоединилась к между-народным конвенциям, соглашениям и договорамв области охраны промышленной собственности.В 1998 году AGEPI продолжило свою постоян-ную деятельность, направленную на соблюдениеобязательств по этим конвенциям, соглашениями договорам в качестве официального предста-вителя Республики Молдова.

Республика Молдова является участницей 15международных договоров, конвенций и согла-шений в области охраны промышленной собст-венности. 1 сентября 1998 года вступило в силуСтрассбургское Соглашение по международнойпатентной классификации, а 28 сентября 1998года Республика Молдова присоединилась к Меж-дународной конвенции по охране селекционныхдостижений.

Таким образом, присоединение к действующиммеждународным договорам, конвенциям и согла-шениям в области промышленной собственностии их ратификация подходят к завершению.

Участие в них вводит Республику Молдова в ми-ровую систему охраны промышленной собствен-ности, благоприятствует развитию собственнойсистемы охраны, облегчает гармонизацию на-ционального законодательства с законодатель-ствами других государств, предоставляет доступк международным совещаниям, конференциям,выставкам, симпозиумам по вопросам охраныпромышленной собственности, создавая в то жевремя различные возможности для междуна-родного и регионального сотрудничества.

Международная деятельность AGEPI, развива-лась главным образом в контексте развертываниямеждународной системы охраны промышленнойсобственности.

In the framework of International Unions andStanding Committees the representatives of theAGEPI participated in the most important meet-ings of the working groups, committees of expertsand governing bodies and in other activities of theWIPO. Members of the AGEPI’s staff activelyparticipated in the works of Standing Committeesand their working groups on main directions relat-ing to the settlement of procedure matters, distri-bution, standardization, management in the fieldof patent information; paid much attention to mat-ters relating to the elaboration of Patent Law Treaty(PLT); contributed to the proceeding of meetingsrelated to the protection of well-known trademarksand other actions organized by WIPO.

WIPO is rendering permanent assistance in theimprovement of professional qualification of thestaff members of the AGEPI, in the organizationof regional seminars, symposiums and conferences.

Provisions of the TRIPs Agreement concerningtrademarks and geographical indications protec-tion, enforcement of the industrial property rightswith respect to counterfeiting to trademarks, ser-vice marks, piracy fighting, the role of CustomsDepartments in the enforcement of industrial prop-erty rights, copyright and neighbouring rights un-der the TRIPs Agreement – these were the datumpoints of a regional two-days seminar (October 21and 22, 1998) “Enforcement of Intellectual Prop-erty Rights” proceeded in Chisinau under the ae-gis of the World Intellectual Property Organiza-tion in co-operation with the State Agency on In-dustrial Property Protection.

World Trade Organization(WTO)

In the joining process of the Republic of Moldovato the World Trade Organization (WTO), the StateAgency on Industrial Property Protection extendsits cooperation with the WTO, focusing it on har-monization of legislation in the field of industrialproperty protection under provisions of the TRIPsAgreement. Within the framework of this coop-eration Matthijs Geuze, Counsellor of the WTOIntellectual Property and Investment Division, hasundertaken a working visit to the AGEPI for ren-dering assistance on matters related to the harmo-nization of national legislation on industrial prop-erty with the provisions of the TRIPs Agreement

Представители Республики Молдова участвовалив работе очередных, внеочередных и специаль-ных совещаний различного уровня, организован-ных ВОИС в рамках Международных союзов иПостоянных комитетов. Сотрудники AGEPIучаствовали в сессиях Постоянных комитетов ирабочих групп ВОИС, в компетенцию которыхвходило решение задач по процедуре, распрос-транению, стандартизации и менеджменту в об-ласти патентной информации; особое вниманиебыло уделено проблемам разработки Договора опатентных законах (PLT), был внесен вклад в ре-шение проблем охраны общеизвестных товарныхзнаков и другие акции, организованные ВОИС.

ВОИС оказывает постоянную помощь в совер-шенствовании квалификации специалистов, ор-ганизации семинаров, симпозиумов, регио-нальных конференций.

Положения Соглашения TRIPs в отношении ох-раны товарных знаков и географических наи-менований, осуществлении прав промышленнойсобственности и борьбы с недобросовестной кон-куренцией в случаях с торговыми и фирменнымиобозначениями и услугами через призму опытапроизводителей, борьбы с пиратством, роли та-моженных органов в осуществлении прав на ин-теллектуальную собственность, авторских исмежных прав в контексте Соглашения TRIPs, яв-лялись темами регионального семинара “Реали-зация прав интеллектуальной собственности”(21–22 октября 1998 г.), состоявшегося в г. Киши-нэу под эгидой Всемирной организации интел-лектуальной собственности и AGEPI.

În anul de bilanţ reprezentanţii Agenţiei auparticipat la lucrările Consiliului TRIPs şila negocierile multilaterale şi bilateraleprivind aderarea Republicii Moldova laOMC, au prezentat rapoarte şi răspunsuriatât oral, cât şi în scris la numeroaseîntrebări, adresate de reprezentanţii ţărilorComunităţii Europene, SUA, Japoniei şi aialtor ţări în domeniul legislaţiei de brevete,protecţiei informaţiei confidenţiale şi asecretelor comerciale, interzicerii con-

tractelor de licenţă care limitează con-curenţa în domeniul protecţiei topografiilorcircuitelor integrate, protecţiei indicaţiilorgeografice, realizării drepturilor de pro-prietate intelectuală. Participarea Agenţiei,în comun cu Ministerul Economiei şiReformelor, precum şi cu MinisterulAfacerilor Externe la întrunirile şi ne-gocierile cu OMC, evident, a contribuit lasporirea eficienţei activităţii acesteia, la im-plementarea unui stil modern de lucru.

During the year under review the representativesof the Agency participated in the TRIPs Councilworks and in multilateral and bilateral negotiationsas for joining of the Republic of Moldova to theWTO, presented reports and answers both orallyand in writing to a lot of questions addressed byrepresentatives of the European Community, USA,Japan and other countries related to the patent leg-islation, protection of confidential information andtrade secrets, prohibition of license contracts thatlimit the competition in the field of protection oftopographies of integrated circuits, protection ofgeographical indications, enforcement of intellec-tual property rights. Participation of the Agency incommon with the Ministry of Economy and Re-forms as well as the Ministry of Foreign Affairs inthe meetings and negotiations with the WTO, con-tributed evidently, to the increasing of the activityefficiency thereof, to the implementation of an up-to-date working style.

The European Patent Office(EPO)

Cooperation with the EPO is carried out both ondirect bilateral relations and the ICON multilat-eral programs, the TACIS regional project (train-ing of the specialists, English Language Courses,technical assistance). Owing to the permanent as-sistance of the EPO, the representatives of theAGEPI, attorneys and judges had the possibilityto attend 13 International Seminars organized indifferent countries within the framework of theICON Program concerning management of patentinformation, examination of inventions in the fieldof chemistry, food industry, pharmaceutical prod-ucts, protection of new plant varieties, inventionsand trademarks registration procedure, enforcementof intellectual property rights and other importantmatters in this field.

Owing to the assistance rendered by the EPO andthe professional re-training course, since the sum-mer of 1998, the AGEPI has the access to theINPADOC database that allows the efficient andqualitative search to be made, determination of thenovelty of inventions as well as carrying on of otherservices. Under the experience accumulated by theAGEPI, the European Patent Office organized in

Участие Агентства совместно с Ми-нистерством экономики и реформ, а также с Ми-нистерством иностранных дел в совещаниях и пе-реговорах с ВТО было успешным и отражало со-временный стиль работы.

Åâðîïåéñêîå ÏàòåíòíîåÂåäîìñòâî (ÅÏÂ)

Сотрудничество с ЕПВ осуществляется как в рам-ках двусторонних прямых связей, так и в рамкахмногосторонних программ ICON, региональногопроекта TACIS (подготовка специалистов, курсыанглийского языка, техническая помощь). Приподдержке ЕПВ представители AGEPI, патент-ные поверенные и юристы принимали участие в13-ти международных семинарах, организован-ных в различных странах в рамках ПрограммыICON, касающихся менеджмента в области па-тентной информации, экспертизы изобретений вобласти химии, пищевой промышленности, фарма-цевтических препаратов, охраны новых сортоврастений, процедуры регистрации изобретений итоварных знаков, реализации прав на интел-лектуальную собственность и другие важные про-блемы в области.

Благодаря помощи, оказанной ЕПВ в обеспече-нии доступа к международной базе данныхINPADOC и проведении курсов по ее использо-ванию, с лета 1998 года AGEPI имеет доступ вэту базу данных, позволяющую эффективное икачественное проведение поиска, определениеновизны изобретений, а также осуществлениедругих услуг. Учитывая опыт, приобретенный

ţările CSI, reprezentanţii AGEPI au activatsistematic în cadrul diferitelor organismeale Convenţiei privind Brevetul Euro-asiatic, au participat la seminarele şi laşedinţele Consiliului Administrativ alOrganizaţiei Euroasiatice de Brevete şi alegrupelor de lucru speciale. De menţionatcă la ultima şedinţă a Consiliului Ad-ministrativ Directorul General AGEPI Eu-gen Staşcov a fost ales vicepreşedinte alacestuia pentru perioada ulterioară.

Participanţii la seminar au fost iniţiaţi înprocedeele de accesare şi exploatare a bazeide date INPADOC – sistem compact al li-teraturii de brevete care conţine date bibli-ografice referitoare la circa 28 mln deinvenţii. Avantajele sistemului INPADOCsunt incontestabile pentru examinatorii deinvenţii şi inventatori în vederea examinăriiriscului de contrafacere, evaluării stadiuluitehnicii şi altor probleme de brevetare.

În 1998 Agenţia de Stat a fost vizitată de odelegaţie a OEB. În cadrul vizitei au fostdiscutate probleme vizând protecţia pro-prietăţii industriale, direcţiile de cooperaredintre AGEPI şi OEB în cadrul ProgramuluiRegional TACIS privind acordarea asis-tenţei, consultaţiilor şi comentariilor pentruarmonizarea legilor în vigoare şi proiectelorde legi ale Republicii Moldova în domeniuconform cerinţelor Acordului TRIPs.

Chisinau a regional Seminar concerning theINPADOC database. The Seminar was managedby Nina Formby and Peter Paris, experts from theEuropean Patent Office. Experts in the field of in-dustrial property protection from 11 countries ofCIS and Mongolia have met at the AGEPI, attend-ing a practical course of a rapid, qualitative andefficient use of INPADOC database, managed Eu-ropean Patent Office, branch from Vienna.

The participants in the seminar were initiated withthe exploitation and accession procedures of theINPADOC database – a compact system of patentliterature which includes bibliographic data relat-ing to about 28 mln of inventions. The advantagesof the INPADOC system are unchallenged for theexaminers of inventions and inventors on exami-nation of counterfeit risk, evaluation of the stateof the art and other patent matters.

In 1998, a delegation from the EPO was on a visitto the AGEPI. Within its framework there havebeen discussed matters on industrial property pro-tection, cooperation relations between the AGEPIand EPO within the framework of the TACIS Re-gional Program concerning rendering of assistance,consultations and comments on harmonization oflaws in force and draft laws of the Republic ofMoldova proceeding from the requirements of theTRIPs Agreement.

The Eurasian Patent Office

During the year under review the State Agencycontinued its activity within the framework of theEurasian Patent Convention which is very impor-tant for the observance of interests of the inven-tors from the Republic of Moldova.

Taking into consideration the great importance ofthe Convention as an instrument of integration pro-cesses carried on in the field of industrial propertyprotection in the CIS countries, the representativesof the AGEPI took an active part in the frameworkof different bodies of the Eurasian Patent Conven-tion, participating in the seminars and meetings ofthe Administrative Council of the Eurasian PatentOrganization and special working groups. It shouldbe mentioned the fact that Eugen Stashkov, Direc-tor General of the AGEPI, at the last meeting ofthe Administrative Council was unanimouslyelected vice – chairman of the Council for the nextperiod.

Участники семинара были введены в курс про-цедур доступа и использования базы данныхINPADOC – компактной системы патентной до-кументации, содержащей библиографическиеданные около 28 млн. изобретений. Преимуще-ства системы INPADOC безусловно важны дляэкспертов изобретений и для изобретателей с це-лью проведения экспертизы на патентную чис-тоту, оценки технического уровня и других про-блем, связанных с патентованием.

В 1998 году Государственное агентство посетиладелегация ЕПВ. В рамках этого визита обсужда-лись вопросы охраны промышленной собствен-ности, направления сотрудничества AGEPI и ЕПВв соответствии с региональной программойTACIS, о возможности оказания помощи, кон-сультаций и комментариев, касающихся гармони-зации действующих законов и проектов законовРеспублики Молдова в области с требованиямиСоглашения TRIPs.

В отчетном году Государственное агентство про-должило деятельность в рамках Евразийской Па-тентной Конвенции, играющей важную роль в со-блюдении интересов изобретателей РеспубликиМолдова.

Принимая во внимание важность Конвенции в ка-честве инструмента в процессах интеграции, осу-ществляемых в области охраны прав промыш-ленной собственности в странах СНГ, предста-вители AGEPI систематически принимают учас-тие в работе различных органов ЕвразийскойПатентной Конвенции, в семинарах и совещанияхАдминистративного Совета Евразийской Патент-ной Организации и специальных рабочих групп.Следует отметить тот факт, что на последнем сове-щании Административного Совета Генеральный

a) cu oficiile de brevete din străinătate înconformitate cu acordurile încheiate;

b) cu organizaţiile şi firmele cu renume,specializate în protecţia proprietăţiiindustriale prin stabilirea relaţiilor directe.

Acordurile bilaterale de colaborare, înche-iate cu un şir de oficii de brevete din lume,constituie baza activităţilor de instruire apersonalului şi schimbului informaţiilor debrevet.

Pe bază bilaterală AGEPI soluţioneazăprobleme vizând schimbul şi valorificareainformaţiilor de brevet. ActualmenteAGEPI realizează pe bază contractuală unasemenea schimb de informaţii cu oficii din32 de ţări. Acordurile bilaterale oferă accesinventatorilor, tuturor persoanelor in-teresate la piaţa internă şi cea externă, lainformaţia de domeniu, în special la ceaprivind proprietatea industrială.

De asemenea, conform acordurilor decolaborare cu alte oficii au fost efectuateschimburi de experienţă, materiale oficiale,normative şi metodice. Vizitele cola-boratorilor AGEPI la alte oficii de brevetesunt extrem de importante. Menţionăm înacest sens vizitele întreprinse la oficiile debrevete din Grecia, Ungaria şi la Oficiulde Brevete şi Mărci din Statele Unite aleAmericii. Ele au oferit posibilitatea fa-miliarizării cu organizarea şi metodele delucru ale instituţiilor cu renume mondial,precum şi cu tradiţiile şi performanţele lor.

În perioada de referinţă au fost aprofundateşi extinse relaţiile de colaborare cuDepartamentul de Comerţ al Statelor Uniteale Americii în cadrul Programului Co-mercial Law Development Program(CLDP). Extention of InternationalCooperation

Promotion of bilateral cooperation is focused ontwo main directions:

a) with the foreign patent offices under provisionsof the signed agreements;

b) by establishment of direct contacts with the or-ganizations and famous companies specialized thatactivate in the field of industrial property protec-tion.

The bilateral cooperation agreements concludedwith many patent offices of the world constitutethe base of training activities and patent informa-tion exchange.

Under bilateral cooperation, the AGEPI settlesmatters on utilization and exchange of patent in-formation. At present, the AGEPI performs undercontractual cooperation such an information ex-change with offices from 32 countries. The bilat-eral agreements open the access of inventors andall interested persons to the internal and externalmarkets, to the information in the field, in particu-lar, that one related to the industrial property.

According to the cooperation agreements withother offices there has also been made an exchangeof experience, official, normative and methodicalmaterials. Visits undertaken by the AGEPI expertsto other patent offices are extremely important forour Agency. It should be mentioned, herein, visitsundertaken to patent offices from Greece, Hungaryand to the Trademark and Patent Office of the USA.They have offered the possibility to get familiar-ized with the organization and working methodsof famous world institutions as well as to the tra-ditions and performances thereof.

During the period under review there have beenthoroughly considered and extended the cooperati-on relations with the Department of Commerce ofthe USA within the framework of the CommercialLaw Development Program (CLDP). As part of thevisit of His Excellency Rudolf Perina, Ambassa-dor of the USA in the Republic of Moldova, ofother representatives of the Embassy and U.S.Department of Commerce to the AGEPI have beendiscussed matters on the extention of cooperationbetween the Republic of Moldova and the United

Развитие процесса двустороннего сотрудничествапроисходит в двух направлениях:

a) с зарубежными патентными ведомствами в со-ответствии с заключенными соглашениями;

b) со специализированными организациями ифирмами в области охраны промышленной собст-венности путем установления прямых связей.

Двусторонние соглашения о сотрудничестве, за-ключенные с многими патентными ведомствами,составляют основу деятельности по обучениюперсонала и обмену патентной информацией.

На двусторонней основе AGEPI решает проблемыобмена и осваивания патентной информации. Внастоящее время AGEPI осуществляет на дого-ворной основе такой обмен информации с 32странами. Двусторонние соглашения открываютдоступ изобретателям, всем заинтересованнымлицам к внутреннему и внешнему рынкам, к ин-формации в области, в частности, в отношениипромышленной собственности.

Кроме того, согласно договору о сотрудничествес другими ведомствами, осуществлялся обменспециалистами, официальными нормативными иметодическими материалами. Визиты сотруд-ников AGEPI в патентные ведомства других странчрезвычайно важны. Следует отметить состояв-шиеся визиты в патентные ведомства Греции,Венгрии и США. Они дали возможность ознако-миться с организацией и методами работы учре-ждений с мировым именем, а также с их тради-циями и достижениями.

За отчетный период были расширены отношениясотрудничества с Департаментом торговли СШАв рамках Коммерческой Программы CLDP. В рам-ках визита Его Превосходительства Rudolf Perina,посла США в Р. Молдова, других представителейПосольства и Департамента Торговли США вAGEPI, были обсуждены пути расширения сот-рудничества между Республикой Молдова и СШАв области охраны промышленной собственности.Особое значение для Департамента информации

Conform Memorandumului de cooperaredintre AGEPI şi Oficiul de Stat pentruInvenţii şi Mărci (OSIM) din România,semnat în timpul vizitei delegaţiei oficialea OSIM la AGEPI sub conducerea Dir-ectorului General Gabor Varga, a fostorganizat un schimb permanent de ex-perienţă privind protecţia invenţiilor,mărcilor, desenelor şi modelelor in-dustriale, promovarea invenţiilor, op-timizarea informării în domeniul protecţ-iei proprietăţii industriale, armonizarealegislaţiei Republicii Moldova cu pre-vederile Acordului TRIPs.

În 1998 AGEPI a continuat să beneficiezede asistenţă tehnică din partea guvernuluibritanic conform programului Know-How-Fund, destinat modernizării Agenţieiîn următorii 5 ani, managementuluifinanciar şi intern, organizării stagieriiexaminatorilor din Republica Moldova.Programul urmăreş te, de asemenea,promovarea invenţiilor, extinderea in-formării din literatura de brevete şiarmonizarea legilor în vigoare şi pro-iectelor de legi ale Republicii Moldova îndomeniul protecţiei proprietăţii industrialecu cerinţele Acordului TRIPs.

Republica Moldova a devenit locul des-făşurării mai multor reuniuni, seminare şiconferinţe internaţionale.

Colaborarea de perspectivă cu organismeleinternaţionale şi oficiile de brevete de pestehotare este o condiţie indispensabilă învederea perfecţionării şi integrării sis-temului de protecţie a proprietăţii in-dustriale al Republicii Moldova în celmondial, armonizării lui cu normeledreptului internaţional.

Of great importance for the Infor-mation Department of the AGEPI were consulta-tions and recommendations of Larry Magnani, rep-resentative of the USA Trademark and Patent Of-fice to the matters related to the services throughINTERNET, integration of databases of the indus-trial property objects, creation of the INTERNETpage, security of information, etc.

Under the cooperation memorandum between theAGEPI and OSIM from Romania, signed duringthe OSIM official delegation’s visit to the AGEPI,led by Gabor Varga, Director General, have beenorganized a permanent exchange of experienceon the protection of inventions, marks, industrialdesigns, promotion of inventions and optimiza-tion of information in the field of industrialproperty protection as well as consultations onthe harmonization of legislations of the Republicof Moldova under the provisions of the TRIPsAgreement.

In 1998, the AGEPI continued to benefit by atechnical assistance program on behalf of the Brit-ish Government, by the Know-How-Fund, pro-vided for the modernization plan of the Agencyduring the following 5 years, internal and finan-cial management, organization of experts trainingin this field within the framework of this program,promotion of inventions and extention of patentinformation and harmonization of laws in force anddraft laws of the Republic of Moldova in the fieldof industrial property protection with the require-ments of the TRIPs Agreement.

The Republic of Moldova has become a display-ing arena for many international meetings, semi-nars and conferences.

The long-term cooperation with the internationalbodies and foreign patent offices constitutes anindispensable and compulsory condition on theimprovement and integration of the industrial prop-erty protection system of the Republic of Moldovainto the world one, harmonization thereof with therules of international law.

AGEPI имели консультации и рекомендации LarryMagnani, представителя Ведомства по патентами товарным знакам США по вопросам, предус-матривающим оказание услуг через INTERNET,интеграцию базы данных объектов промышлен-ной собственности , создание страницыINTERNET, безопасность информации и т. д.

Согласно меморандуму о сотрудничестве междуAGEPI и Государственным ведомством по изо-бретениям и товарным знакам (OSIM) Румынии,который был подписан во время визита офици-альной делегации OSIM под руководством Гене-рального директора Gabor Varga в AGEPI, былорганизован обмен опытом в области охраны изо-бретений, товарных знаков, промышленных ри-сунков и моделей, продвижения изобретений, оп-тимизации информации в области охраны про-мышленной собственности, а также состоялиськонсультации по гармонизации законодательст-ва Республики Молдова согласно положениямСоглашения TRIPs.

В 1998 году AGEPI продолжило использованиепрограммы технической помощи со стороны пра-вительства Великобритании через фонд Know-How, предназначенной для реализации планамодернизации Агентства в последующие пять лет,совершенствования финансового менеджмента,организации стажировок экспертов РеспубликиМолдова, продвижения изобретений и патентнойинформации, гармонизации действующих зако-нов и проектов законов Республики Молдова вобласти охраны промышленной собственностисогласно требованиям Соглашения TRIPs.

Республика Молдова стала местом проведениямногих международных совещаний, семинаров иконференций.

Перспективное сотрудничество с международ-ными организациями и патентными ведомствамиявляется обязательным условием для совер-шенствования и интеграции системы охраны про-мышленной собственности Республики Молдо-ва в мировую систему, ее гармонизации с норма-ми международного права.

A plicarea şi dezvoltareatehnologiilor informaţionale augenerat performanţe noi, re-

voluţionare în reţeaua de calculatoareAGEPILAN. Noile sisteme, lansate pepiaţa tehnicii de calcul, caracterizate prinridicarea nivelului de securitate, prinmodalitatea simplă de exploatare şiadministrare, au impus modernizareaîntregului parc de calculatoare. În vedereaprevenirii incompatibilităţii sistemelor şia consolidării securităţii informaţiilor a fostunificată platforma reţelei de calculatoare,utilizându-se mijloacele soft, livrate deacelaşi producător, inclusiv mijloace degenerare a programelor pentru ajustare şiperfecţionare. Această unificare esteimportantă şi pentru integrarea în reţeleleglobale de tip INTERNET în scopulfurnizării informaţiilor atât consumatorilorinterni, cât şi celor externi şi al transferuluieficient de informaţii între oficiile deproprietate intelectuală, alte organizaţii.

Factorul decisiv în dezvoltarea capacităţiisistemului informatic constă în crearea re-ţelei teritoriale de proprietate intelectualăAGEPINET, care va servi ca bază de in-tegrare în reţeaua INTERNET. Cerinţeleprincipale privind transferul de informaţiila distanţe mari între oficiile de proprietateintelectuală vor fi respectate prin integrareareţelei locale în cadrul reţelei globaleWIPONET. Anul 1998 a fost remarcabil şiprin faptul că în cadrul Organizaţiei Mon-diale de Proprietate Intelectuală a fost creatComitetul Permanent pentru Tehnologii In-formaţionale. Specialiştii de la AGEPI auluat parte activă la primele sesiuni ale acestuiComitet, contribuind ulterior la aplicarea înpractică a proiectelor recomandate.

În 1998 a continuat perfecţionarea sis-temului informaţional:

n a crescut numărul de calculatoare,repartizate în toate secţiile (câte un cal-culator la două persoane în majoritateasecţiilor, iar în unele câte un calculatorpentru fiecare persoană);

n au fost completate colecţiile de CD-ROM ale AGEPI cu discurile optice“Invenţii înregistrate în RepublicaMoldova în anii 1993–1997” şi “Le-gislaţia Republicii Moldova în do-meniul protecţiei proprietăţii indus-triale”;

n au fost perfecţionate bazele de date deinvenţii şi mărci;

n a fost lansată pagina INTERNET;

n au fost modernizate mijloacele edi-toriale şi implementat corectorul delimbă română;

n au fost implementate unele softuri deautomatizare a activităţii economice, decadre şi secretariat etc.

În cadrul Agenţiei au fost organizate cursuride informatică cu genericul “Exploatareamijloacelor elementare şi elaborareadocumentelor”, cursuri de instruire aexaminatorilor privind utilizarea discuriloroptice, exploatarea sistemului Mimosa,sistem generalizat pentru efectuareacercetărilor documentare în colecţia dediscuri optice din străinătate.

Application and development of informa-tional technologies have led to new radi-cal performances within the framework of

the AGEPILAN computer system. The new sys-tems launched on the hardware market character-ized by increasing of the security level, by the com-mon exploitation and management modality, haveimposed upgrading of the whole computer system.In order to prevent the incompatibility of systemsand consolidation of information security it hasbeen unified the platform of computer network,using software means delivered by the same pro-ducer, including means for engendering of adjust-ment and improvement programs. This unificationis useful as well for integration into the interna-tional INTERNET systems with a view of supply-ing information to both national and foreign con-sumers and efficient transfer of information amongthe intellectual property offices and other organi-zations.

The decisive factor in the development of the in-formational system capacity consists in the creationof a territorial AGEPINET system of intellectualproperty that will serve as a base of integration intothe INTERNET system. The main conditions onthe transfer of information at long distances amongthe intellectual property offices should be met byintegration of the local system into the internationalWIPONET system. The year of 1998 was also re-markable by the fact that within the framework ofthe World Intellectual Property Organization hasbeen created the Standing Committee on Informa-tion Technologies. Experts from the AGEPI tookan active part in the first sessions of said Commit-tee, mobilizing, subsequently, their activity to theenforcement of recommended projects.

With the upgrading of the computer system theExamination Department was sufficiently providedwith the performed technique for carrying out ofsearch using the national database and optical disks.Simultaneously, a CD-ROM Server has been cre-ated for the simplification of searching procedureusing the ROMARIN database and efficient trans-fer of information to said department.

Применение и развитие информационныхтехнологий привело к новым революци-онным преобразованиям в рамках ком-

пьютерной сети AGEPILAN. Новые системы, по-ступившие на рынок компьютерной техники, от-личающиеся повышенным уровнем безопасно-сти, упрощением эксплуатации и управления, вы-звали модернизацию всего компьютерного арсе-нала. Для предотвращения несовместимости сис-тем и сохранения безопасности информации былаунифицирована компьютерная сеть путем исполь-зования средств программного обеспечения, пос-тавляемых теми же производителями, включаясредства управления программами для настрой-ки и совершенствования. Эта унификация имеетпреимущества и для интеграции в мировую сетьтипа INTERNET с целью получения информациикак для внутренних потребителей, так и для внеш-них, а также для эффективного обмена информа-цией с патентными ведомствами, организациямиинтеллектуальной собственности и другими орга-низациями.

Решающим фактором в развитии емкости инфор-мационной системы является создание террито-риальной сети интеллектуальной собственностиAGEPINET, которая будет служить базой для ин-теграции в сеть INTERNET. Основные требова-ния в отношении передачи информации на боль-шие расстояния между ведомствами интеллектуа-льной собственности будут соблюдаться благода-ря интеграции местной сети в рамки всемирнойсети WIPONET. 1998 год был примечателен и тем,что в рамках ВОИС был создан Постоянный ко-митет по информационным технологиям. Специа-листы AGEPI принимали активное участие в пер-вых заседаниях этого Комитета, в результате чегопретворяли в жизнь рекомендованные проекты.

Одновременно с модернизацией компьютерногоарсенала, Департамент экспертизы был оснащентехникой для проведения патентных исследова-ний, используя национальную базу данных и оп-тические диски. Кроме того, был создан СерверCD-ROM для упрощения процедуры патентногопоиска, используя базу данных ROMARIN, и эф-фективной передачи информации в рамках упо-мянутого департамента.

In 1998 the informational system endured impor-tant modifications such as:

n increasing of the computers number, distributedto all sections (most of the sections having acomputer for two persons and some of themhaving a computer for each person);

n completion of the CD-ROM collections of theAGEPI with the optical disks “Inventions reg-istered in the Republic of Moldova in the pe-riod of 1993 – 1997” and “Law of the Republicof Moldova in the field of industrial propertyprotection”;

n improvement of Trademarks and Inventionsdatabases;

n implementation of INTERNET network system;

n upgrading of editorial means and implementa-tion of a proof-reader of the romanian language;

n implementation of certain softwares for the au-tomation of economic, staff and secretariate ac-tivity, etc.

Data processing courses with the main title “Ex-ploitation of elementary means and elaboration ofdocuments”, professional re-training courses onutilization of optical disks, exploitation of Mimosasystem, a generalized system for carrying out ofsearches in the optical disc collection from abroadhave been organized within the Agency.

n увеличение числа компьютеров, установлен-ных во всех отделах, исходя из количествасотрудников: по одному компьютеру на двухспециалистов в большинстве отделов, в неко-торых отделах – по одному компьютеру на спе-циалиста;

n комплектование коллекций CD-ROMовAGEPI оптическими дисками “Изобретения,зарегистрированные в Республике Молдова за1993–1997 гг.” и “Законодательство Республи-ки Молдова в области охраны промышленнойсобственности”;

n совершенствование базы данных изобретенийи товарных знаков;

n выпуск страницы ИНТЕРНЕТ;

n модернизация издательских средств и введе-ние корректора румынского языка;

n программное обеспечение по автоматизацииэкономической деятельности, работы с кадра-ми, секретариата и т.д.

Организация курсов по информатике под назва-нием “Использование элементарных средств иразработка документов” явилась шагом в подго-товке кадров AGEPI к работе с электронныминосителями данных. За отчетный период былиразвернуты курсы по обучению экспертов в об-ласти использования оптических дисков, систе-мы Mimosa, разработанной для выполнения па-тентных исследований в базах данных иностран-ных оптических дисков.

Informarea din literatura de brevete camijloc eficient de documentareconstituie pentru utilizatori o sursă

sigură şi veridică privind realizările deultimă oră din diferite ramuri ale ştiinţei şitehnicii, rezultatele finale ale cercetărilorşi elaborărilor.

În scopul înlesnirii accesului utilizatorilorla bazele de date interne în 1998 au fostelaborate principiile de organizare a Col-ecţiei naţionale de brevete (CNB) şi deasistenţă informaţională în domeniulprotecţiei proprietăţii industriale în Repub-lica Moldova. Au fost definite structura şicomponenţa acesteia, sursele de con-stituire, modul de completare şi evidenţă,condiţiile de păstrare, procedurile de-servirii informaţionale şi bibliografico-informaţionale; au fost determinate sar-cinile şi scopurile privind extinderea şimodernizarea CNB în contextul dezvoltăriisistemului mondial al informării dinliteratura de brevete. De asemenea, au fostpropuse căi de obţinere a rezultatelorscontate, bazate pe utilizarea noilortehnologii informaţionale pe suporturielectronice.

Una din atribuţiile principale ale Agenţieieste constituirea şi întreţinerea CNB, carereprezintă o bază informaţională unică asistemului de brevete, starea căreiainfluenţează direct calitatea informaţiei şia serviciilor prestate.

Biblioteca AGEPI efectuează completareaşi evidenţa circulaţiei CNB, constituireamasivelor documentare, prelucrareatematică şi statistică a acestora, difuzareapublicaţiilor AGEPI în ţară şi peste hotare,inclusiv schimbul de publicaţii cu oficiilede brevete străine şi organizaţiile inter-naţionale.

VII. Activitatea informa\ional=

În 1998 a crescut numărul cititorilor (cu50%), în special din rândul reprezentanţilororganizaţiilor şi întreprinderilor busi-nessului mic şi mijlociu.

Propagarea pe larg a protecţiei proprietăţiiindustriale în instituţiile de învăţământ acontribuit la sporirea interesului faţă deinformarea din brevete (numărul cititorilor-studenţi a crescut de 2 ori).

Sala de lectură a bibliotecii dispune de treistaţii locale CD-ROM. Ţinând cont de evo-luţia rapidă a tehnologiilor informaţionale,în general, şi de planurile strategice aleOMPI de creare a reţelei informaţionaleglobale, în particular, problema principalăsoluţionată de serviciul informaţional alAGEPI în perioada de bilanţ a fost reori-entarea modalităţii de stocare a informa-ţiilor de la suporturi de hârtie la suporturielectronice. Colecţia de documente de bre-vet din străinătate, primită în cadrulschimbului bilateral, s-a completat cubazele de date – ESPACE–ACCESS, EU-ROPE (OEB), GLOBALPat şi USAMark(SUA). La dispoziţia utilizatorilor sunt şibazele de date din Federaţia Rusă: Des-crierile complete, Rezumatele, Indexulcomplet al colecţiei Federaţiei Ruse.

În perioada de bilanţ colecţia de CD-ROMs-a completat cu mai mult de 1000 dediscuri, atingând la sfârşitul anului 1998cifra de 3,5 mii. În consecinţă examinatoriiau posibilitatea de a efectua documentăriatât în bazele de date externe, cât şi în celeinterne. O mare parte din colecţia de CD-ROM o constituie discurile proprii:Infoinvent cu date bibliografice aleinvenţiilor create de inventatorii moldoveniîn anii 1963–1992; Infoinvent ColecţiaAGEPI cu invenţii înregistrate în Repub-lica Moldova în anii 1993–1997.

Information from the patent literature as an ef-ficient means of information and search con-stitutes for readers a reliable and believable

source about the last achievements in differentbranches of science and technology, final resultsof investigations and elaborations.

In order to advantage from the users access to thehome database, the organizational principles of theNational Patent Collection (NPC) and informa-tional assistance in the field of industrial propertyprotection in the Republic of Moldova have beenelaborated in 1998. It were defined the NPC struc-ture and composition, constitution sources, evi-dence and completion mode, maintenance condi-tions, informational and bibliographical informa-tional serving procedures; tasks and purposes onthe extention and upgrading of NPC in the devel-opment process of the international patent infor-mation system have been determined. Methods forobtaining of discounted results based on utiliza-tion of new contemporary informational technolo-gies on electronic carriers have also been proposed.

One of the main assigments of the Agency con-sists in the creation and maintenance of NPC, thatrepresents an unique informational base of thepatent system, the state of which directly influ-ences upon the information and performed ser-vices quality.

The AGEPI library concerns itself with the comple-tion and evidence of the NPC circulation, carrieson the constitution of documentation bulks, the sta-tistical and thematic processing thereof, distribu-tion of the AGEPI publications over the country,encouraging of international exchange of officialpublications with the foreign patent offices andinternational organizations.

In 1998, it has been increased the number of read-ers (with 50%), especially, from the organizationsand enterprises, representatives of small and me-dium business.

The propagation and increasing of matters relat-ing to the industrial property protection within the

Для дальнейшего анализа проблем развития на-циональной патентно-информационной базы,обеспечивающей информацией различные кате-гории потребителей, в 1998 г. были разработаны“Принципы организации Национального патент-ного фонда (НПФ) и информационного обслужи-вания в области охраны промышленной собствен-ности в Республике Молдова”. В рамках назван-ного документа проведена оценка текущего со-стояния проблемы, определены задачи и цели,стоящие перед AGEPI, по расширению и модер-низации НПФ в контексте развития мировой па-тентно-информационной системы, предложеныпути достижения поставленных целей, опираю-щиеся на использование современных информа-ционных технологий и электронных носителейданных.

Одной из основных функций AGEPI являетсяформирование и поддержание НПФ, состояниекоторого оказывает существенное влияние накачество предоставляемой информации и ус-луг.

Библиотека AGEPI занимается вопросами ком-плектования и учёта движения НПФ, проводитформирование массивов документов, их статисти-ческую и тематическую обработку, распростра-няет издания Агентства в стране, а также участ-вует в процессе международного обмена офици-альными изданиями с патентными ведомствамизарубежных стран и международными организа-циями.

В 1998 г. отмечено увеличение числа читателейна 50%, в том числе за счёт представителейорганизаций и предприятий малого и среднегобизнеса.

Широкая пропаганда и усиление внимания в учеб-ных заведениях правовым вопросам охраныпромышленной собственности повысили интереск патентной информации среди учащейся моло-

În procesul de colaborare cu OMPI AGEPIa participat la studierea şi evaluarea

propunerilor prezentate de Comitetul deExperţi privind Clasificarea internaţionalăde brevete (CIB), modificarea redacţiei a7-ea CIB, modificarea Îndrumarului CIBşi chestiunilor de procedură de verificare aCIB. Sistematic au fost examinate pro-iectele Comitetului Permanent pentru Teh-nologii Informaţionale (CPTI), în com-ponenţa căruia a fost integrat ComitetulPermanent pentru Informaţii în DomeniulProprietăţii Industriale (CPIPI) şi au fostcercetate posibilităţile de aplicare arecomandărilor CPTI în activitatea AGEPI.Ca şi în anii precedenţi au fost pregătite şiexpediate la OMPI dările de seamă anualeale activităţii informaţionale tehnice aAGEPI în domeniul invenţiilor, desenelorşi modelelor industriale şi mărcilor.

Agenţia participă activ la completareacolecţiei de brevete a Bibliotecii tehnico-ştiinţifice republicane, care dispune de unfond bogat de titluri de protecţie.

The reading hall of the library has three local CD-ROM stations. Taking into account the rapid evo-lution of the informational technologies and theWIPO strategic plans for the creation of an inter-national information network, in particular, themain problem of the AGEPI informational ser-vice during the period under review has been thereorientation of passing from paper carriers toelectronic carriers. The patent documentationcollection from abroad, received as a result of bi-lateral exchange, has been completed with impor-tant databases, such as ESPACE-ACCESS, EU-ROPE (EPO), GLOBALPat and USAMark(USA). At the users disposal there are also data-bases from the Russian Federation: Thorough de-scriptions, Abstracts, the whole Index of the Rus-sian Federation collection.

During the period under review, the AGEPI col-lection of CD-ROMs was completed with morethan 1000 of disks so that at the end of 1998 reachedthe number of 3,5 thousand of disks. Thus, the ex-perts have the possibility of carrying out searchesin both foreign and home databases. A great partof the AGEPI collection on CD-ROM constituteits own disks: Infoinvent containing bibliographicdata of the inventions created by Moldavian in-ventors in the period of 1963 – 1992; AGEPI Col-lection Infoinvent containing inventions registeredin the Republic of Moldova in the period of 1993 –1997.

The experts of the AGEPI and users from outsidecan obtain the necessary information for the evalu-ation of the state of the art during the examinationprocedure, disclosure of the invention in the elabo-ration and drafting of documents enclosed to thepatent application by means of the following data-bases (DB) on electronic carriers:

n 4 bibliographic;

n 7 summary;

n 12 complete patent specifications;

n 5 informative.

Учитывая бурное раз-витие информационных технологий, в целом, истратегические планы ВОИС на создание гло-бальной информационной сети, в частности, ос-новной задачей информационной службы AGEPIв отчётном году стала переориентация с бумаж-ных носителей на электронные носители данных.Фонд иностранной патентной документации, по-лучаемой в рамках двустороннего обмена, попол-нился такими значительными базами данных, какESPACE - ACCESS EUROPE (ЕПВ), GLOBALPatи USAMark (США). Приобретены также россий-ские базы данных: Патенты России (полные опи-сания), Патенты России (рефераты), Комплекс-ный итоговый указатель к фонду Российской Фе-дерации.

CD-ROM-коллекция AGEPI возросла за год бо-лее, чем на 1000 дисков и составила к концу отчёт-ного периода более 3,5 тыс. дисков. Возможно-сти проведения безбумажного поиска информа-ции расширены как за счёт увеличившегося объ-ема поступлений иностранных CD-ROM, так иза счёт создания автоматизированных баз данныхотечественной патентной документации. Важнойсоставной частью CD-ROM коллекции AGEPIявляются отечественные диски: Infoinvent, содер-жащий библиографический указатель изобрете-ний, созданных молдавскими изобретателями с1963 г. по 1992 г., и Infoinvent Colecţia AGEPI, со-держащий изобретения, зарегистрированные вРеспублике Молдова с 1993 по 1997 гг.

Информация, используемая как сотрудникамиподразделений AGEPI, так и сторонними потре-бителями, для целей установления уровня техни-ки при экспертизе изобретений, выявленияизобретений в процессе разработки или состав-ления материалов заявки на изобретение, доступ-на через следующие базы данных (БД) на элек-тронных носителях:

Said databases enable to carry on the search fordifferent periods on the following PCT-min StateMembers: Austria, Germany, USA, Switzerland,Japan and on the international PCT applications.

At the AGEPI’s experts disposal through INTERNETthere is available the INPADOC PFS/INL database.

During the cooperation process with WIPO, theAGEPI took an active part in the examination andevaluation of the proposals suggested by the Com-mittee of Experts of the International Patent Classi-fication Union, modification and explanation of theIPC 7-th edition, modification of the IPC Guideand the IPC checking procedure matters. It was sys-tematically carried on the analysis of the StandingCommittee on Information Technologies (SCIT)drafts, within which was integrated the PermanentCommittee for Information in the field of Industri-al Property (PCIPI) and have been examined thepossibilities of applying the PCIPI recommenda-tions in the AGEPI activity. There have been prepa-red and sent to WIPO the annual reports concern-ing the technical information activity of the AGEPIin the field of inventions, industrial designs andtrademarks.

The Agency takes an active part in the creation ofpatent collection within the national technical andscientific library possessing a rich retrospectivefund of titles of protection.

The National Collection of Patent Documents atthe end of 1998 is presented in Table 10.

Кроме того, в распоряжении экспертов AGEPI ссередины 1998 г. через Internet находитсяINPADOC БД PFS/INL.

В процессе сотрудничества с ВОИС AGEPIпринимало участие в изучении и оценке предло-жений, вносимых Комитетом экспертов по Меж-дународной патентной классификации (МПК), поизменению и уточнению 7-ой редакции МПК, поизменению Руководства по МПК и процедурныхвопросов ревизии МПК. Проводилась система-тическая работа по анализу проектов Постоянно-го комитета по информационным технологиям(ПКИТ), в рамки которого был интегрированПКИПС, и исследовались возможности примене-ния рекомендаций ПКИТ в деятельности AGEPI.Как и в предыдущие годы, были подготовлены инаправлены в ВОИС годовые технические отче-ты об информационной деятельности AGEPI в об-ласти патентов, промышленных образцов и то-варных знаков.

Активное участие Агентство принимает в форми-ровании патентного фонда Республиканской науч-но-технической библиотеки, в распоряжении ко-торой находится обширный ретроспективныйфонд охранных документов.

В таблице 10 представлен Национальный патен-тный фонд по состоянию на конец 1998 года.

R idicarea nivelului profesionalconstituie una dintre direcţiileprioritare în activitatea AGEPI.

Din momentul fondării, AGEPI acordă odeosebită atenţie acestei probleme, iniţiinddiverse forme de instruire şi reciclare acadrelor:

n cursuri pentru consilieri în proprietateindustrială;

n cursuri de instruire şi atestare a man-datarilor autorizaţi;

n cursuri pentru consilieri în proprietateindustrială, desfăşurate la OSIM (Ofi-ciul de Stat pentru Invenţii şi Mărci dinRomânia) şi ANCPIR (Asociaţia Na-ţională a Consilierilor în ProprietateIndustrială din România);

n stagierea la oficiile de proprietateindustrială din străinătate;

n participarea la seminare şi conferinţeinternaţionale.

Programa de instruire la AGEPI a fost de220 de ore cu susţinerea a 5 examene. 35de persoane, inclusiv 16 colaboratori aiAgenţiei, au obţinut diplome de consilier.

VIII. Preg=tirea cadrelor

Cursurile OSIM şi ANCPIR cu instruireala Bucureşti şi Chişinău au fost de 120 deore, absolvindu-le 29 de persoane, inclusiv21 din cadrul Agenţiei.

În 1998 au fost atestaţi 23 de mandatariautorizaţi. La finele anului de referinţănumărul mandatarilor autorizaţi înregistraţila AGEPI era de 36.

La sesiunile şi conferinţele internaţionaleau participat 22 de colaboratori ai AGEPI.

O parte din colaboratorii AGEPI fac studiipostuniversitare, studiază limbi străine. Înanul de referinţă 18 colaboratori au studiatlimba engleză, iar 10 colaboratori au studiatlimba franceză.

Doi colaboratori din secţia economie aufrecventat cursuri de audit.

În baza experienţei acumulate în instruireapersonalului în domeniul protecţiei juridiceşi comercializării obiectelor proprietăţiiindustriale AGEPI a prezentat în 1998 unset de materiale la Ministerul Educaţiei şiŞtiinţei, obţinând la 6 octombrie 1998autorizaţia privind crearea Institutului deProprietate Industrială.

Training of Staff is one of the priorest direc-tions in the AGEPI’s activity. Since its foun-dation, the AGEPI paid much attention to

this problem initiating diverse forms of professionalre-training of the staff:n courses for training of patent counsellors;n courses for training and certification of patent

attorneys;n courses for experts in the field of industrial

property upheld with the OSIM (State Officefor Inventions and Trademarks from Romania)and ANCPIR (National Association of PatentCounsellors from Romania);

n training with the industrial property offices fromabroad;

n participation in the international seminars andconferences.

A training program of 220 hours upheld directlywith the AGEPI ended with 5 examinations. 35persons were granted diplomas, 16 of them beingemployees of the AGEPI.

The OSIM and ANCPIR courses of 120 hours withtheir training in Bucharest and Chisinau weregraduated by 29 persons, among them 21 from theAGEPI.

23 patent attorneys were confirmed in 1998. OnJanuary 1, 1999 there were 36 patent attorneys.

A part of the AGEPI’s employees attend the sec-ond faculty by correspondence in high educationalinstitutions, study foreign languages. During theyear under review 18 employees studied Englishand 10 employees studied French.

Due to the accumulated experience in training ofthe staff in the field of legal protection and mar-keting of industrial property objects in 1998, theAGEPI transmitted a set of documents to the Min-istry of Education and Science on the creation ofthe Institute on Industrial Property Protection andon October 6, 1998 received the authorizationthereof.

Одной из основных задач совершенствованияпатентной системы является повышение про-фессионального уровня специалистов. Реше-

нием этой задачи AGEPI занимается с момента сво-его создания, при этом используются различныеформы:n курсы AGEPI по подготовке патентоведов в об-

ласти охраны промышленной собственности;n подготовка и аттестация патентных поверенных;n курсы по подготовке специалистов промыш-

ленной собственности, организованные OSIM(Государственное ведомство по изобретениям итоварным знакам Румынии) и ANCPIR (Румын-ская ассоциация специалистов в области про-мышленной собственности);

n стажировки в патентных ведомствах зарубежныхстран;

n участие в работе международных семинаров иконференций.

Так, занятия на курсах AGEPI проводились по 220часовой программе и завершились сдачей экзаме-нов по 5 дисциплинам. По результатам экзаменовдипломы патентоведа получили 35 слушателей, изних 16 – сотрудники AGEPI.

Курсы OSIM и ANCPIR проводились по 120 часо-вой программе в Бухаресте и в Кишинэу. Обучениепрошли 29 специалистов, из них 21 – сотрудникиAGEPI.

В 1998 году были проведены две сессии по аттес-тации патентных поверенных. Аттестовано 23 чело-века. На 1 января 1999 года список патентных пове-ренных включает 36 человек.

22 сотрудника AGEPI приняли участие в между-народных совещаниях и семинарах.

Многие специалисты AGEPI продолжают заочноеобучение в высших учебных заведениях с цельюполучения второго высшего образования, на курсахизучения иностранных языков. Так, в 1998 году 18сотрудников AGEPI занимались на курсах англий-ского языка, а 10 сотрудников - на курсах француз-ского языка.

Два сотрудника экономического отдела закончиликурсы аудиторов.

На основании имеющегося опыта по подготовкекадров в области правовой охраны и коммерческогоиспользования объектов промышленной собствен-ности в 1998 году AGEPI представило в Министер-ство образования и науки разработанные програм-мы и комплект документов по созданию Институтапромышленной собственности. 6 октября 1998 годалицензия на создание названного Института была по-лучена.

minarele, expoziţiile, reuniunile de afaceri,schimbul util de informaţii, consultaţiile despecialitate sunt doar câteva dintre acţiunileîntreprinse de AGEPI în acest sens. Întabelul 11 sunt prezentate informaţiisuccinte despre principalele seminare şiexpoziţii organizate de AGEPI în 1998.

Pe parcursul anului a fost desfăşurată oactivitate intensă de susţinere, stimulare şipromovare a procesului inventiv.

IX. Seminare [i expozi\ii

Statul acordă o atenţie deosebită inven-tatorilor, obligând toate persoanele fiziceşi juridice, indiferent de forma de pro-prietate, să remunereze orice utilizare ainvenţiilor în sfera productivă.

Parlamentul Republicii Moldova a in-stituit titlul onorific “Om Emerit” care sedecernează prin decret prezidenţialautorilor pentru rezultate remarcabile înmuncă. Astfel, în 1998, pentru crearea şiimplementarea unor invenţii, de acest titlus-au învrednicit:

The State Agency on Industrial Property Pro-tection has close cooperation with inven-tors. Seminars, exhibitions, business meet-

ings, useful information exchange, mutual consul-tations – these are some of the actions undertakenby the AGEPI. The brief information about themain seminars and exhibitions organized by AGEPIin 1998 is presented in Table 11.

During the year under review there has been car-ried on an activity for maintenance, stimulation andpromotion of the inventive activities.

The Government pays an exquisite attention to in-ventors, compelling all legal and natural persons,notwithstanding the form of property, to remuner-ate any use of inventions in the production field.

The Parliament of the Republic of Moldova hasinstituted the honorary title “Honoured Man” whichis conferred by a presidential decree to authors fortheir remarkable efforts. Thus, in 1998, for the cre-ation and implementation of some inventions suchtitle was conferred to:

It should be mentioned the fact that the first spe-cialized exhibition “Know-How Exchange ‘98”, or-ganized at the International Exhibition Centre“Moldexpo”, constituted a real test for the wholesociety concerning the intellectual and technicalpotential of the national science, activity of par-ticular inventors, technical and scientific creationof children, new approaches to the current prob-lems of the economy of the Republic of Moldovaat the cross-road of two millenniums. 60 enterprisesand 6 private inventors took part in it, being ex-hibited 230 of models of inventions. 24 prizes havebeen awarded, including 4 prizes in the field of

нары, выставки, деловые совещания, полезныйобмен информацией, консультации – это лишь не-которые виды деятельности, осуществляемойAGEPI в данном контексте. В таблице 11 пред-ставлена краткая информация об основных семи-нарах и выставках, организованных AGEPI в 1998году.

В течение года осуществлялась работа по под-держке, стимулированию, пропагандированиюизобретательской деятельности.

Государство уделяет особое внимание изобрета-телям, вменяя в обязанность всем физическим июридическим лицам, независимо от формы соб-ственности, возмещать ущерб за использованиеизобретений в сфере производства.

Парламент Республики Молдова учредил почет-ное звание “ Om Emerit “, которое присваиваетсяуказом президента авторам за отличные резуль-таты в труде. Так, в 1998 году за создание и вы-полнение некоторых изобретений такое званиебыло присвоено:

Виктору Ковалеву, ведущему специалисту Науч-ного центра прикладной химии и экологии Госу-дарственного университета Молдовы;

S-au acordat 24 depremii, inclusiv 4 premii în domeniultehnicii medicale, 3 în agricultură şi 3pentru aparate-instalaţii, câte două îndomeniile chimie, ecologie şi artizanat.Câte un premiu a revenit informaticii,biotehnologiei şi creaţiei tinerilor. Toateinvenţiile premiate la expoziţia “Know-How Exchange ‘98”, precum şi cele men-ţionate la saloanele mondiale de invenţii,vor fi propuse pentru Expoziţia Mondialăde la Hanovra, Germania, din anul 2000.

O semnificaţie deosebită comportă des-făşurarea anuală a Salonului tinerilorinventatori care şi-a câştigat un bun nume.În anul de bilanţ circa 70 de tineri in-ventatori din republică au participat lamaratonul inovaţional al tineretului,materializat prin Salonul Internaţional“Inventică-Creativitate-Inovare ’98” carea avut loc la Centrul “Moldexpo”. Au fostexaminate peste 80 de elaborări dupăcriteriile de creativitate, noutate şi ap-licabilitate industrială.

Aprize was awarded in the field of information sci-ence, biotechnology and creation of the youth. Allinventions awarded at the exhibition “Know-HowExchange’ 98” as well as those mentioned at theinternational exhibitions of inventions should bepromoted for the Hanover World Exhibition, Ger-many, from 2000.

An exquisite semnification involves the annual dis-play of the International Exhibition of young in-ventors that gained a renown. During the year un-der review about 70 of young inventors from ourrepublic took an active part in the innovatory mara-thon of young researchers materialized by the In-ternational Exhibition “Invention-Creativity-Inno-vation’ 98”, that took place in the “Moldexpo”Centre. About 80 of elaborations have been exam-ined under the criteria of the: inventive step, nov-elty and industrial application.

AGEPI permanently provides financial assistanceto the inventors groups for participation thereof inthe international exhibitions, for elaboration andimplementation of stands and models of some exhi-bits that are to be presented within the exhibitions.

Herein, it should be mentioned the relevant exhi-bitions from Hungary and Romania, to which thecreativity of our conationals has been highly esti-mated. The delegation of the Republic of Moldovamanaged by I. Daniliuc, First Deputy DirectorGeneral of the AGEPI, composed of 13 inventorsfrom the State University of Moldova (SUM), StateUniversity of Medicine and Pharmacy (SUMF),Institute of Chemistry of the Academy of Sciencesof the Republic of Moldova, and other institutions,who took part in the Inventors Olimpic Games“Genius’ 98” organized in Budapest, was the mostnumerous group after that of the host country.Elaborations suggested by Moldavian inventorswere mainly from the fundamental sciences andwere awarded 11 olimpic medals and the GreatSilver Medal “Genius’ 98”, awarded to LevPanasiuc, Professor from the Department in Elec-tronics of the State University of the Republic ofMoldova for his invention “Devices and methodsfor photothermoplastic registration”.

Особое значение имеет ежегодное проведениеВыставки молодых изобретателей, которая хоро-шо зарекомендовала себя. В отчетном году около70 молодых изобретателей республики участ-вовали в инновационном марафоне , состоявшем-ся в рамках Международного салона “Инвенти-ка-Созидательность-Инновация’98”, состоявшем-ся в Центре “Moldexpo”. Было рассмотрено свы-ше 80 разработок на соответствие критериямизобретательского уровня, новизны и промыш-ленной применимости.

AGEPI оказывает постоянную финансовую под-держку группам изобретателей для участия в ме-ждународных выставках, при разработке и выпол-нении стендов, макетов, экспонатов, которыедолжны быть представлены на выставках.

Следует отметить выставки в Венгрии и Румынии,где изобретательская деятельность наших сограж-дан была оценена высшими наградами. ДелегацияРеспублики Молдова под руководством И. Дани-люка, первого заместителя генерального директораAGEPI, в составе 13 изобретателей из Госу-ниверситета Молдовы (USM), Государственногомедицинско-фармацевтического университета Рес-публики Молдова (USMF), Института химии Ака-демии наук Республики Молдова, участвовавшаяв Олимпийских играх изобретателей “Genius’98”в Будапеште, была одной из самых многочислен-ных. AGEPI acordă permanent sprijin financiarechipelor de inventatori pentru participarela expoziţii internaţionale, pentru ela-borarea şi realizarea standurilor şi ma-chetelor ce urmează a fi prezentate în cadrulexpoziţiilor.

În această ordine de idei sunt relevanteexpoziţiile din Ungaria şi România la carecreativitatea conaţionalilor noştri a fostestimată la cel mai înalt nivel. EchipaRepublicii Moldova condusă de Ion Da-niliuc, prim-vicedirector general al AGEPI,formată din 13 inventatori de la Uni-versitatea de Stat din Moldova (USM),Universitatea de Stat de Medicină şiFarmacie (USMF), Institutul de Chimie alAcademiei de Ştiinţe a Republicii Moldovaşi de la alte instituţii, care a participat laJocurile Olimpice ale Inventatorilor “Ge-nius ‘98” organizate la Budapesta, a fostcea mai numeroasă, fiind depăşită doar deţara-gazdă. Elaborările propuse de in-ventatorii moldoveni ţin de domeniul ştiin-ţelor fundamentale şi au fost apreciate cu11 medalii olimpice şi Marea Medalie deArgint “Genius ’98”, decernată pro-fesorului Lev Panasiuc de la Catedra deelectronică a USM pentru invenţia “Dis-pozitive şi procedee pentru înregistrareafototermoplastică”.

Pentru munca depusă la etapa preliminară,contribuţie la constituirea unei echipereprezentative Agenţiei de Stat pentru Prot-ecţia Proprietăţii Industriale i s-a acordat omedalie olimpică de excepţie.

În anul de referinţă inventatorii dinRepublica Moldova au participat pentruprima dată la cel de-al XXVI-lea SalonInternaţional de Invenţii desfăşurat laGeneva. Au fost prezentate invenţii ce sereferă la medicină şi ocrotirea sănătăţii,protecţia mediului, mecanică şi produseindustriale, electronică, mijloace de trans-port, construcţii, securitate, sport şidivertisment, articole noi cu aplicare înviaţa cotidiană.

La Salonul al XIII-lea Internaţional de In-venţii, Cercetări şi Produse Noi din Pitts-burgh (SUA) la care au participat 40 deţări Republica Moldova a prezentat 16lucrări create în cadrul Universităţii de Statdin Moldova, Universităţii Tehnice dinMoldova, Academiei de Ştiinţe a Re-publicii Moldova, diverselor instituţii şti-inţifice şi de producţie. Rezultatul par-ticipării inventatorilor moldoveni a depă-şit orice aşteptare: trei medalii de aur, trei –de argint, patru – de bronz, două premiispeciale ale juriului, inclusiv MarelePremiu acordat inventatorilor prof. dr.Aurelian Gulea şi prof. dr. Valeriu Rudic.Printre cei premiaţi se înscriu şi aca-demicianul Ion Bostan, profesorul Ion To-deraş, inginerul Valentin Alimbocico, di-rectorul întreprinderii mixte “ACVOIR”Marin Usatâi.

Cele patru cicluri de invenţii prezentate deun grup de cercetători moldoveni la Salonulal IV-lea Mondial African de Invenţii,Cercetări şi Produse Noi de la Casablancaau fost apreciate, fiecare, cu câte o medaliede aur. La această manifestare, la care şi-au expus lucrările solii a 22 de state alelumii, inventatorii republicii noastre au fostinvitaţi la recepţia oferită de prinţulMarocului, Abdelatip Habck. Autoriiciclului de invenţii “Procedee de depoluarea apelor contaminate cu radionuclizi prov-eniţi din industria nucleară”, distins cuMedalia de Aur în cadrul SalonuluiMondial, sunt prof. dr. Aurelian Gulea,şeful catedrei de chimie anorganică a USM,şi prof. dr. Valeriu Rudic, membru core-spondent, directorul Institutului de Mic-robiologie al AŞRM. Lucrările lor au fostdistinse cu Premiul special al MinisteruluiAfacerilor Externe al Marocului. Acad. IonBostan, rectorul UTM, împreună cucoautorii, a fost medaliat cu aur pentruciclul de invenţii intitulat “Transmisiiplanetare precesionale”. Medalia de Aur arevenit şi prof. dr. Constantin Spânu pentrunoi produse medicale cu acţiuni antivirale.

For the first time, during the year under review,inventors from the Republic of Moldova took anactive part in the 26-th International Exhibition ofInventions organized in Geneva. Inventions in thefield of medicine and strengthening of health, envi-ronmental protection, mechanics and industrial pro-ducts, electronics, transport facilities, construc-tions, security, sport and entertainment, new articleswith application in daily life have been presentedthere.

At the XIII-th International Exhibition of Inven-tions, Investigations and New Products from Pitts-burgh (USA), in which participated 40 countries,the Republic of Moldova presented 16 works crea-ted at the State University from Moldova, Techni-cal University from Moldova, Academy of Scien-ces of the Republic of Moldova (ASRM), diversescientific and manufacturing institutions. The parti-cipation result of Moldavian inventors outrun anyexpectation: three gold medals, three silver med-als, four bronze medals, two special prizes of jurycommittee, including the Great Prize awarded tothe inventors Prof. Dr. Aurelian Gulea and Prof.Dr. Valeriu Rudic. Among the awarded personsrange as well the academician Ion Bostan, profes-sor Ion Toderaş, engineer Valentin Alimbocico, di-rector of the mixed enterprise “ACVOIR” MarinUsatâi.

The four cycles of inventions presented by a groupof Moldavian researchers at the IV-th World Afri-can Exhibition of Inventions, Investigations andNew Products from Casablanca have been esti-mated, each, with a gold medal. To this manifesta-tion, in which messengers of 22 states of the worldexhibited their works, the inventors of our repub-lic have been invited at the reception offered bythe Prince of Morocco, Abdelatip Habck. The au-thors of the invention cycle “Processes fordepollution of waters contaminated with radionu-clides proceeded from nuclear industry”, distin-guished with the gold medal in the World Exhibi-tion are Prof. Dr. Valeriu Rudic, member corres-pondent, Director of Microbiology Institute of theASRM and Prof. Dr. Aurelian Gulea, Head of theDepartment in the Inorganic Chemistry of theSUM. Their works were awarded the special Prizeof the Ministry of Foreign Affairs of Morocco. The

O contribuţie valoroasă la activitatea in-ventivă este adusă de femeile inventatoare.Guvernul Republicii Moldova promovea-ză şi încurajează creativitatea şi in-ventivitatea femeilor, apreciind rolul lor îndezvoltarea ştiinţei şi tehnicii, în afaceri şisocietate în general. Acad. Ion Bostan, rector of the TUM, together withthe joint authors, was awarded the Gold Medal forthe invention cycle entitled “Precession planetarytransmissions”. Prof. Dr. Constantin Spânu wasawarded the Gold Medal for new medical prod-ucts possessing antiviral properties. The cup ofCasablanca city was handed to the inventors A.Gulea and V. Rudic for the elaboration of a micro-biologic radionuclide collecting method.

A valuable contribution to the inventive activity isbrought in by women inventors. The Governmentof the Republic of Moldova promotes and stimu-lates the creativity and inventiveness of women,emphasizing their role in the development of sci-ence and technology, business and society in gen-eral. Most of the inventions created by women in-ventors from our country originate in the field ofbiotechnology, microbiology, food industry, agri-culture, medicine, viticulture and vinification, eco-logical chemistry etc.

Over 260 patents have been granted to women in-ventors from Moldova just in the functioning pe-riod of 5 years of the national industrial propertyprotection system. The great achievements ofwomen inventors Liliana Cepoi, Lidia Gavriliţă,Maria Duca, Galina Lupaşcu were awarded 10 goldand silver medals at the International Exhibitionorganized in Budapest (Hungary), Bruxelles (Bel-gium), Pittsburgh (USA), Casablanca (Morocco),Bucharest (Romania) and in Chisinau (Republicof Moldova).

In September of the year under review, an Exhibi-tion devoted to the creation of women inventorshas been organized with the World Intellectual Pro-perty Organization (Geneva), wherein informativematerials on the activity of women inventors fromthe Republic of Moldova have been exhibited.

Each year, the Agency promotes the most deserv-ing inventors to the awarding of the WIPO GoldMedal. The Gold Medal of the World IntellectualProperty Organization (WIPO) was awarded in1998 to Gheorghe Duca, corresponding memberof the ASRM, doctor, university professor, initia-tor of the chair in ecological and industrial chem-istry of the SUM, chairman of parliamentary Boardon culture, education, science and informationmeans, in taken of recognition of his achievementsas a topnotch inventor and for his contribution tothe promotion of science, technology and inven-tory activity in the Republic of Moldova.

Большинство изобретений, создан-ных женщинами-изобретателями нашей респуб-лики, относится к областям биотехнологии, мик-робиологии, пищевой промышленности, сельско-го хозяйства, медицины, виноградарства, вино-делия, химии, экологии и т.д.

Более 260 патентов были выданы женщинам-изо-бретателям Республики Молдова за 5-летний пе-риод работы национальной системы охраны про-мышленной собственности. Высокие достиженияженщин-изобретателей Лилианы Чепой, ЛидииГаврилицы, Марии Дука, Галины Лупашку былиоценены 10 золотыми и серебряными медалямина Международных выставках, организованных вБудапеште (Венгрия), Брюсселе (Бельгия), Питтс-бурге (США), Касабланке (Марокко), Бухаресте(Румыния) и в Кишинэу (Республика Молдова).

В сентябре отчетного года Всемирная организа-ция интеллектуальной собственности (Женева)организовала Выставку-Салон, посвященныйдеятельности женщин-изобретателей, где быливыставлены информационные материалы, посвя-щенные работам женщин Республики Молдова.

Buletinul Oficial de Proprietate Indus-trială (BOPI), cartea de vizită a AGEPI,apare lunar şi este expediat în peste 40

de ţări. Este unica revistă din Republica Mol-dova învestită cu dreptul de a furniza informaţiiasupra diferitelor categorii de obiecte ale pro-prietăţii industriale pentru care s-a solicitat saus-a acordat protecţia juridică (invenţii, modelede utilitate, mărci, denumiri de origine a pro-duselor, desene /modele industriale), asupra mo-dificărilor, adăugirilor şi corecturilor aduse tex-telor sau datelor bibliografice ale documentelorpublicate, asupra statutului juridic al cererilorşi titlurilor de protecţie. Buletinul Oficial deProprietate Industrială publică operativ dateledespre contractele de cesiune şi licenţă înregis-trate la AGEPI, actele legislative şi normativecare reglementează protecţia proprietăţii indus-triale în Republica Moldova, relevă mecanismulde integrare a ţării în sistemul mondial de pro-prietate industrială.

În anul de referinţă în BOPI au fost publicatedatele reglementare privind 1092 de cereri încare a fost solicitată protecţia juridică adiferitelor obiecte de proprietate industrială,inclusiv: 108 cereri de brevet, 2 cereri deînregistrare a modelelor de utilitate, 5 cereri deînregistrare a denumirilor de origine a pro-duselor, 977 de cereri de înregistrare a mărcilorşi 1056 de titluri de protecţie acordate, inclusiv:236 de brevete de invenţie, 5 certificate de

înregistrare a modelelor de utilitate, 762 de cer-tificate de înregistrare a mărcilor, 52 de certifi-cate de înregistrare a desenelor/modelelorindustriale, un certificat de înregistrare adenumirii de origine a produsului. Au fost deasemenea publicate informaţii succinte privind20 de mărci reînnoite, 149 de modificări, 38 decontracte de cesiune, un contract de licenţă şi 2de franchising înregistrate, rezultatele exa-minării contestaţiilor, numeroase materiale dedocumentare, anexele semestriale incluzândlistele sistematizate ale brevetelor acordate şimărcilor înregistrate în Republica Moldova.

Alte publicaţii periodice ale AGEPI oferăpublicului cititor diversă informaţie privindactivitatea inventivă din ţară, reflectă par-ticiparea savanţilor, cercetătorilor şi in-ventatorilor moldoveni la expoziţiile naţionaleşi internaţionale. Lista publicaţiilor periodices-a completat cu o nouă apariţie “AGEPI Re-vue”. Suplimentele revistei “Intellectus” –“Bursa Invenţiilor”, “AGEPI Consultă”,“AGEPI Info”, “AGEPI Expo” şi-au majorattirajul şi şi-au modernizat structura.

Официальный бюллетень промышленнойсобственности (BOPI) – визитная карточ-ка AGEPI, издается ежемесячно и рассы-

лается в 40 стран мира. Это единственный жур-нал в Республике Молдова, наделенный правомпредставления информации о различных катего-риях объектов промышленной собственности, накоторые заявлена либо предоставлена юридиче-ская охрана (изобретения, полезные модели, то-варные знаки, наименования мест происхожде-ния товаров, промышленные рисунки и модели),об изменениях, дополнениях и исправлениях при-веденных текстов или библиографических дан-ных опубликованных материалов, о юридиче-ском статусе заявок и охранных документов. BOPIоперативно публикует данные о договорах по пе-реуступке прав и лицензионных договорах, заре-гистрированных в AGEPI, законодательных инормативных актах, регламентирующих охранупромышленной собственности в РеспубликеМолдова, отражает механизм интеграции респуб-лики в мировую систему промышленной собст-венности.

В отчетном году в BOPI были опубликованы дан-ные, относящиеся к 1092 заявкам, в которых былаиспрошена юридическая охрана на различныеобъекты промышленной собственности, включая:108 заявок на изобретения, 2 заявки на регистра-цию полезных моделей, 5 заявок на регистрациюнаименований мест происхождения товаров, 977заявок на регистрацию товарных знаков, и 1056выданным охранным документам, включая 236патентов на изобретения, 5 свидетельств о реги-страции полезных моделей, 762 свидетельства орегистрации товарных знаков, 52 свидетельствао регистрации промышленных рисунков и моде-лей, 1 свидетельство о регистрации наименова-ния места происхождения товаров. Была такжеопубликована краткая информация о 20 восста-новленных товарных знаках, 149 изменениях, 38договорах о переуступке прав, 1 лицензионномдоговоре и 2 договорах о франшизинге, резуль-татах по рассмотренным возражениям; представ-лены многочисленные материалы о патентных ис-следованиях, полугодовые приложения, вклю-чающие систематизированные перечни выданныхпатентов и свидетельств о товарных знаках, за-регистрированных в Республике Молдова.

The Official Bulletin of Industrial Property(BOPI), the visiting card of the AGEPI, ismonthly published and sent to 40 countries.

It is the only journal in the Republic of Moldovainvested with the right to furnish information ondifferent categories of industrial property objectsfor which legal protection was sought or granted(inventions, utility models, trademarks, appella-tions of origin of goods, industrial designs), onmodifications, additions and corrections to the textsor bibliographic data of the published documents,on the legal status of the applications and titles ofprotection. The Official Bulletin of Industrial Prop-erty operatively publishes data on cession and li-cense agreements registered with the AGEPI, leg-islative and normative acts regulating the indus-trial property protection in the Republic ofMoldova, points out the integration mechanism ofthe country into the international system of indus-trial property.

During the year under review, in the BOPI havebeen published regular data on 1092 applicationsin which has been sought legal protection of dif-ferent industrial property objects, including: 108patent applications, 2 applications for the registra-tion of utility models, 5 applications for the regis-tration of appellations of origin of goods, 977 ap-plications for the registration of marks and 1056of granted titles of protection, including: 236 pat-ents for inventions, 5 certificates of registration ofutility models, 762 certificates of registration ofmarks, 52 certificates of registration of industrialdesigns, a certificate of registration of the appella-tion of origin of goods. There has also been pub-lished concise information concerning 20 renewedtrademarks, 149 modifications, 38 cession agree-ments, one license agreement and 2 registered fran-chising agreements, examination results of the ap-peals, a great deal of documentation materials, half-yearly annexes including systematized lists ofgranted patents and registered marks in the Repub-lic of Moldova.

The periodical publications of the AGEPI offer thereaders different information on the creative ac-tivity from the country. The list of periodical pub-

lications was completed with a new publication“AGEPI Revue”, reflecting the participation ofMoldavian scientists, researchers, inventors in thenational and international exhibitions. Supplementsto the “Intellectus” journal – “Bursa Invenţiilor”,“AGEPI Consultă”, “AGEPI Info”, “AGEPI Expo”have increased their circulation and modernizedtheir structure.

For the information of users and for propagationof achievements in the field of industrial propertyprotection, the AGEPI sends its publications, in-cluding official journals and the annual report tosubscribers and free of charge to the state authori-ties, different organizations, enterprises and higheducational institutions from the republic.

Другие периодические издания AGEPI предла-гают широкому кругу читателей информацию обизобретательской деятельности в стране, отража-ют участие молдавских ученых, исследователейи изобретателей в национальных и международ-ных выставках. Список периодических изданийдополнен новой публикацией “AGEPI Revue”.Приложения к журналу “Intellectus” – “Bursa Inv-enţiilor”, “AGEPI Consultă”, “AGEPI Info”,“AGEPI Expo” увеличили свой тираж и измени-ли структуру.

Unul dintre obiectivele Agenţiei deStat pentru Protecţia ProprietăţiiIndustriale este prestarea ser-

viciilor în domeniul brevetelor şi alinformaţiei persoanelor fizice şi juridicedin sfera activităţii inventive şi de an-treprenoriat. Prospectul serviciilor AGEPIinserează o listă impunătoare de servicii îndomeniul brevetelor, de consulting, precumşi alte servicii referitoare la protecţiaproprietăţii industriale.

Activitatea AGEPI în ceea ce priveşteacordarea de servicii întreprinderilor serealizează pe principii de autogestiune,implementând politica flexibilităţii preţ-urilor. În vederea reglementării raporturilorcu beneficiarii şi în temeiul unei generaliză-ri a experienţei acumulate au fost elabo-rate tarife aferente serviciilor de informare,de consulting, precum şi ale altor genuride servicii.

Pe parcursul anului 1998 circa 100 depersoane fizice şi juridice au apelat laserviciile AGEPI în scopul soluţionăriiunor sarcini bine delimitate, dintre care 25au beneficiat prin abonament de serviciicomplexe în domeniul brevetelor şi in-formaţiei.

În perioada respectivă s-au efectuat:

n redactarea materialelor de cerere de înr-egistrare a obiectelor de proprietate in-dustrială:l brevete de invenţie – 6;l desene / modele industriale – 8;l mărci conform procedurii naţionale –

În diferite judeţe ale republicii, sub egidaAGEPI, s-au desfăşurat seminare cugenericul Protecţia proprietăţii industrialela întreprinderi.

Serviciile în domeniul brevetelor şi in-formaţiei sunt prestate atât de colaboratoriigrupului servicii de la AGEPI, cât şi de alţispecialişti: profesori de la instituţiile deînvăţământ superior, colaboratori de la ins-tituţiile de cercetări ştiinţifice, consilieri înproprietatea industrială, toţi absolvenţi aicursurilor de consilieri de la AGEPI. Aceştispecialişti îşi desfăşoară activitatea îndomeniul prestării serviciilor în baza unorcontracte încheiate cu Agenţia.

În perspectivă se prevăd acţiuni al cărorscop este de a atrage beneficiari noi, anumeprin:

n crearea unei reţele de centre regionalede informaţie analitică şi generarea unuiaparat de informare şi documentare pelângă fondul de brevete, sistematizatdupă principalele genuri de activitate aorganizaţiilor şi întreprinderilor dinteritoriul respectiv;

n organizarea expoziţiilor itinerante cudemonstrarea publicaţiilor în domeniulbrevetelor, metodico-normative etc., cuacordarea consultaţiilor privind pro-cedura de înregistrare a obiectelor deproprietate industrială şi legislaţia îndomeniu;

n generarea unei baze de date a inova-ţiilor.

One of the objectives of the State Agencyon Industrial Property Protection consistsin rendering patent information services

to legal and natural persons from the inventive andentrepreneurial activity field. The service prospec-tus of the AGEPI inserts an impressive list of ser-vices in the field of patents, consulting as well asother services relating to the industrial propertyprotection.

The AGEPI’s activity as far as providing of ser-vices to enterprises is carried out on principles offinancial self-administration, implementing the costflexibility policy. With reference to the settlementof relations with the beneficiaries and on the groundof generalization of the accumulated experience,tariffs have been elaborated due to the informa-tion, consulting and other kinds of services.

During the year 1998 about 100 legal and naturalpersons have appealed to the AGEPI’s services inorder to fulfil certain delimited tasks, 25 of whichhave enjoyed by subscription complex services inthe field of patents and information.

During the said period there have been performedthe following:

n elaboration of documents of the applicationsfor the registration of industrial property ob-jects:

l patents for invention – 6;

l industrial designs – 8;

l trademarks according to the national proce-dure – 33;

l trademarks according to the Madrid proce-dure – 3;

n thematic search proceeding from the patent lit-erature – 8;

n thematic search proceeding from the mark lit-erature – 21;

n consultations relating to the protection of in-dustrial property objects rights, as well as thelegislation in the said field – 261.

Одним из направлений деятельностиAGEPI является патентно-информаци-онное обслуживание инновационных

процессов и предпринимательской деятельно-сти. В проспект услуг AGEPI включен значи-тельный перечень патентных, консультацион-ных и иных видов услуг в области охраны про-мышленной собственности, юридические и эко-номические консультации.

Деятельность AGEPI в сфере оказания услугпредприятиям и организациям осуществляет-ся на хозрасчетной основе с использованиемгибкой ценовой политики. С целью упорядоче-ния отношений с заказчиками на основе обоб-щения опыта практической работы разработа-ны тарифы на информационные, консалтинго-вые и другие виды услуг.

За 1998 г. около 100 физических и юридическихлиц заключили договоры на выполнение услугдля решения конкретных задач, 25 из них – накомплексное патентно-информационное або-нентское обслуживание.

За отчетный год:

n оформлено заявочных материалов на реги-страцию объектов промышленной собствен-ности:

l изобретений – 6;

l промышленных рисунков и моделей – 8 ;

l товарных знаков – 33;

l товарных знаков по Мадридской процеду-ре – 3;

n выполнено тематических патентных поис-ков – 8;

n выполнено поисков по товарным знакам –21;

Under the aegis of the AGEPI, seminars on the Pro-tection of Industrial Property at the Enterprises havebeen carried on in different counties of the republic.

Patent and information services are provided bothby the collaborators of the servicing group fromthe AGEPI and by other experts: professors of higheducational institutions, collaborators of researchinstitutions, industrial property counsellors, gradu-ates of counsellor courses from the AGEPI. Theseexperts carry out their activity in the servicing fieldunder certain agreements concluded with theAgency.

In the future there are foreseen actions, the aim ofwhich is to attract new beneficiaries, namely by:

n Creation of certain networks of regional ana-lytic information centers and creation of an in-formation and search apparatus about the patentfund, systematized according to the main kindsof activity of organizations and enterprises fromthe respective district.

n Organization of itinerant exhibitions with thedemonstration of publications in the field ofpatents, methodical normative publications etc.,with the provision of consultations concerningthe registration procedure of industrial propertyobjects and the legislation in the field.

n Creation of an innovation database.

Проводились выездные семинары на тему: “Ох-рана промышленной собственности на пред-приятии” в различных регионах республики.

Работы по патентно-информационным услугамвыполняются как штатными сотрудникамигруппы услуг, так и внештатными из числа пре-подавателей ВУЗов, сотрудников НИИ, патен-товедов и др., получивших специальное обра-зование в AGEPI и заключивших контракты сАгентством.

В перспективе предусмотрен ряд мероприятийпо более эффективному привлечению потенци-альных заказчиков к сотрудничеству с AGEPI:

n формирование сети региональных информа-ционно-аналитических центров с созданиемв них автоматизированных СПА к патентно-му фонду по основным направлениям дея-тельности организаций и предприятий ре-гиона;

n организация выездных выставок последнихпоступлений патентной, нормативно-мето-дической и другой литературы с оказаниемконсультационных услуг по вопросам реги-страции объектов промышленной собствен-ности и по законодательству в области ох-раны промышленной собственности;

n создание банка данных инноваций.
