Aderarea României la Uniunea Europeanã la 1 ianuarie 2007 obligã autoritatea românã de concurenþã sã continue ºi sã consolideze ritmul sãu de activitate pentru pregãtirea adecvatã a etapei post-aderare.

În acest sens, de un real sprijin este noul Proiect de Twinning „Atingerea la data

aderãrii a unei capacitãþi administrative ºi de aplicare a acquis-ului comunitar

în domeniul concurenþei ºi ajutorului de stat corespunzãtoare unui Stat

Membru”.

În cadrul proiectului, în perioada 29-30 noiembrie, a avut loc o vizitã a delegaþiei DG Concurenþã cu participarea doamnei Blanca Rodriguez - Director Relaþii Internaþionale, domnului Ansgar Held ºi domnului Koen van de Casteele, responsabili pentru România.

Cu aceastã ocazie au fost prezentate prioritãþile Consiliului Concurenþei pentru perioada urmãtoare:

· funcþionarea autoritãþii de concurenþã dupã 1 ianuarie 2007; · cooperarea dintre DG Concurenþã ºi Consiliul Concurenþei;

· modalitatea de exercitare a noilor atribuþii în domeniul ajutorului de stat;

· statutul de membru al Reþelei Europene de Concurenþã.

În cadrul convorbirilor care au avut loc au fost prezentate, de asemenea, realizãrile obþinute de Inspectoratele teritoriale ale Consiliului Concurenþei în activitatea de promovare a culturii concurenþei.

stRomania's accession to the European Union at the 1 of January 2007 determines the Romanian competition authority to continue and to consolidate its rhythm of activity for an appropriate preparation of the post-accession period.

In this respect, a real support is represented by the new Twinning Project “Advancing

the administrative capacity and application of the acquis in the competition

and State aid area, coherent with the Member State status at the date of

accession”.

Within the Project, during 29-30 November was carried out a visit of the DG Competition delegation represented by Mrs. Blanca Rodriguez - Director, International Relations, Mr. Ansgar Held and Mr. Koen van de Casteele, responsible with Romania.

With this occasion were presented the priorities of the Competition Council for the next period:

st· the functioning of the competition authority after the 1 January 2007; · the cooperation between DG Competition and the Competition Council;

· the manner of exerting the new attributions in the field of State aid;

· the status of member of the European Competition Network.

The discussions were also focused on presenting the achievements of the Territorial Inspectorates of the Competition Council in promoting the competition culture.

· 9 noiembrie - cu ocazia aniversãrii a 15 ani de la înfiinþarea Comisiei pentru Protecþia Concurenþei (CPC) din Bulgaria, o delegaþie condusã de domnul Mihai Berinde, Preºedintele Consiliului Concurenþei, a participat la Ziua Concurenþei , eveniment organizat la Sofia.

La acest eveniment au fost prezentate atât rezultatele ºi experienþele obþinute de CPC în aplicarea regulilor de concurenþã, cât ºi obiectivele pe care aceasta ºi le propune sã le atingã în viitor; au fost abordate teme referitoare la rolul autoritãþilor de concurenþã în economia europeanã ºi efectul aderãrii asupra politicii de concurenþã din noile state membre.

· 16-17 noiembrie - la invitaþia autoritãþii de concurenþã din Turcia, o delegaþie condusã de domnul Mihai Berinde, Preºedintele Consiliului Concurenþei, a efectuat o vizitã oficialã de lucru la Ankara.

Vizita a fãcut parte din seria de acþiuni derulate de autoritãþile de concurenþã din România ºi Turcia în baza protocolului de colaborare pe care preºedinþii celor douã instituþii l-au semnat la Bucureºti, în anul 2005.

Obiectivul principal al vizitei a fost intensificarea cooperãrii bilaterale româno-turce în domeniul concurenþei.

În cadrul convorbirilor bilaterale au fost discutate: progresele recent înregistrate în implementarea ºi promovarea regulilor de concurenþã, tehnici de colectare a informaþiilor în investigarea cartelurilor, utilizarea analizei economice în aplicarea regulilor antitrust, cooperarea dintre autoritatea de concurenþã ºi autoritãþile de reglementare, precum ºi cazuri relevante din domeniul antitrust.Cu aceastã ocazie, au fost identificate ºi modalitãþi concrete de continuare a cooperãrii ºi a schimbului de experienþã dintre cele douã autoritãþi în domeniul antitrust.

· 28-29 noiembrie - cu ocazia aniversãrii a 15 ani de la înfiinþarea Autoritãþii de concurenþã din Cehia, o delegaþie condusã de domnul Mihai Berinde, Preºedintele Consiliului Concurenþei, a participat la conferinþa Concurenþã ºi competitivitate, eveniment desfãºurat la Brno.

Cu aceastã ocazie au avut loc prezentãri cu privire la: relaþia dintre concurenþã ºi competitivitate, rolul instanþelor în aplicarea dreptului concurenþei, relaþia dintre concurenþã ºi reglementãrile sectoriale ºi abordãri curente privind abuzul de poziþie dominantã.

Totodatã au fost prezentate teme privind politica de concurenþã la nivel european ºi au fost identificate modalitãþi concrete de colaborare ºi schimb de experienþã în domeniul ajutorului de stat.

· November, 9 - with the occasion of celebrating 15 years from the establishment of the Commission for Protection of Competition (CPC) from Bulgaria, a delegation led by Mr. Mihai Berinde, the President of the Competition Council, attended Competition Day, event which was organized in Sofia.

At this event were presented the results and the experience of the CPC in enforcing the competition rules, as well as the future objectives of the competition authority; with this occasion were debated issues regarding the role of the competition authorities in the European economy and the effect of the accession over the competition policy in the new Member States.

· November, 16-17 - at the invitation of the Turkish Competition Authority, a delegation led by Mr. Mihai Berinde, the President of the Competition Council, carried out an official working visit in Ankara.

The visit is part of the series of actions undertaken by the competition authorities from Romania and Turkey based on the Memorandum of Understanding signed in 2005 at Bucharest by the Presidents of the two institutions.

The main objective of the visit was the intensification of the bilateral cooperation between Romania and Turkey in the field of competition.

Within the bilateral talks were debated: the recent progresses registered in enforcing and promoting the competition rules, information collecting techniques in investigating cartels, the economic analyses in applying the antitrust rules, the cooperation between the competition authority and the regulatory authorities, as well as certain relevant cases in the antitrust field.With this occasion were also identified the concrete manners of the cooperation and the exchange of experience between the two institutions in the field of antitrust.

· November, 28-29 - with the occasion of celebrating 15 years from the establishment of the Czech Competition Authority, a delegation led by Mr. Mihai Berinde, the President of the Competition Council, attended the conference Competition and competitiveness, event which was organized at Brno.

With this occasion the following were presented: the competition-competitiveness relation, the role of the courts in applying the competition law, the relation competition-sectoral regulations and the recent approaches on the abuse of dominant position.

In the same time were presented certain issues regarding the competition policy at the European level and were identified the concrete manners of collaboration and exchange of experience in the field of State aid.

În luna noiembrie activitatea de promovare a culturii concurenþei a vizat cu precãdere

autoritãþile publice centrale ºi locale, autoritãþile de reglementare sectorialã ºi mediul de

afaceri.

Principalele acþiuni s-au concretizat în:

· participare la ºedinþa Consiliului Consultativ al Autoritãþii Naþionale de Reglementare

în domeniul Gazelor Naturale (ANRGN) unde au fost discutate aspecte specifice

sectorului vizând mediul concurenþial - 9 noiembrie, sediul ANRGN;

· participare la seminarul cu tema „Aspecte practice ale legislaþiei privind concurenþa.

Ajutorul de Stat. Reglementãri aplicabile începând cu anul 2007” organizat de revista

„Bilanþ” - 15 noiembrie, sediul Camerei de Comerþ ºi Industrie a României;

· participare la seminarul „Ziua europeanã a concurenþei ºi competitivitãþii în

România, ediþia a II-a - legislaþia în domeniul concurenþei; pericole ºi capcane pentru

agenþii economici”, organizat de Platforma CEFTAC ºi Eurolink-Casa Europei, sub Înaltul

Patronaj al Preºedinþiei Uniunii Europene - 23 noiembrie, Palatul Parlamentului;

· participare la seminarul privind „Reabilitarea reþelelor de apã din România”,

organizat de Ministerul Mediului ºi Gospodãririi Apelor - 21 noiembrie, sediul Crawn

Plaza;

· participare la seminarul cu tema „Proiectul de lege privind investiþiile”, organizat de

cãtre Alianþa pentru Dezvoltarea Economicã a României - 21 noiembrie, sediul

Camerei de Comerþ ºi Industrie a României;

· participare la seminarul având ca tematicã Ajutorul de stat în agriculturã” organizat

de Direcþia Generalã Agriculturã din cadrul Comisiei Europene - 22 noiembrie, sediul

Best Western Parc Hotel;

· publicarea ghidului „Transparenþa financiarã - Oglinda banului public”; acesta a fost

realizat pentru a veni în sprijinul autoritãþilor publice centrale sau locale, precum ºi a

întreprinderilor publice care acordã sau utilizeazã fonduri publice ºi care intrã sub

incidenþa „Regulamentului privind transparenþa relaþiilor financiare între autoritãþile

publice ºi întreprinderile publice, precum ºi transparenþa financiarã în cadrul anumitor

întreprinderi”, emis de Consiliul Concurenþei.

La nivel local, Consiliul Concurenþei a organizat un numãr de 39 de evenimente de promovare a

culturii concurenþei cu tematicã în domeniul concurenþei ºi al ajutorului de stat, dupã cum

urmeazã:

· 19 seminarii organizate de inspectoratele teritoriale de concurenþã Alba, Bihor,

Braºov, Bucureºti ºi judeþul Ilfov, Buzãu, Caraº-Severin, Dolj, Galaþi, Iaºi, Maramureº,

Mureº, Prahova, Sibiu, Suceava ºi Vaslui; 15 dintre aceste seminarii s-au desfãºurat în

colaborare cu camere de comerþ ºi industrie locale, autoritãþi publice locale ºi asociaþii

profesionale;

· 12 mese rotunde privind regulile aplicabile în domeniul concurenþei ºi al ajutorului de

stat, organizate de inspectoratele teritoriale de concurenþã Braºov, Covasna, Iaºi,

Gorj, Maramureº, Olt, Sibiu, Teleorman ºi Vrancea; 3 dintre aceste mese rotunde

au fost organizate împreunã cu asociaþii ale mediului de afaceri, unitãþi de învãþãmânt

universitar, precum ºi cu sprijinul autoritãþilor locale;

· 8 întâlniri ºi ateliere de lucru organizate de inspectoratele teritoriale de concurenþã

Bacãu, Braºov, Dolj, Teleorman, Sibiu ºi Vaslui; la aceste acþiuni au participat

reprezentanþi ai mediului de afaceri, precum ºi ai autoritãþilor publice locale.

De asemenea, experþi din cadrul inspectoratelor de concurenþã Bacãu, Braºov, Dolj,

Teleorman, Sibiu ºi Vaslui au participat la 9 seminarii ºi întâlniri de lucru organizate de alte

instituþii. Dintre subiectele tratate amintim: ajutorul de stat din perspectiva aderãrii la Uniunea

Europeanã; obligaþiile care revin atât autoritãþilor publice locale, cât ºi agenþilor economici, de a

respecta regulile privind ajutorul de stat, raportarea ºi monitorizarea ajutoarelor de stat;

prezentarea legislaþiei specifice concurenþei ºi ajutorului de stat.


PROMOVAREA CULTURII CONCURENÞEI

During November the activity for promoting competition culture focused mainly on the central

and local administrations, the sectoral regulatory authorities and the business environment.

The main actions were concretized in:

· attending the meeting of the Consultative Council of the National Regulatory

Authority in the field of Natural Gases (NRANG) where were debated specific issues involving the sector, issues with impact over the competitive environment- November, 9 - NRANG headquarters;

· attending the seminar on “Aspects of the practice within the competition legislation. The State aid. Regulations applicable starting with 2007, organized by the magazine “Bilanþ” - November, 15, headquarters of the Chamber of Commerce and Industry of Romania;

· attending the seminar “European Competition and Competitiveness Day in Romania , ndthe II edition - legislation in the field of competition; dangers and traps for the

undertakings”, organized by the CEFTAC Platform and Eurolink-House of Europe, under the High Patronage of the European Union Presidency - November, 23, the Parliament Palace;

· attending the seminar regarding the “Rehabilitation of the water networks from

Romania”, organized by the Ministry of Environment and Waters Management - November, 21, headquarters of Crawn Plaza;

· attending the seminar on the “Draft Law on investments” organized by the Alliance

for the Romania's Economic Development - November, 21, headquarters of the Chamber of Commerce and Industry of Romania;

· attending the seminar having the theme ”The State aid in agriculture” organized by

the general Directorate Agriculture within the European Commission - November, 22, headquarters of the Best Western Parc Hotel;

· publishing the guide “The financial transparency - Mirror of the public money”; it was

elaborated for the support for the central or local authorities, as well as for the public undertakings granting or using public funds falling under the “Regulation on the transparency of the financial relations between the public authorities and the public undertakings, as well as the transparency of the financial relations within certain undertakings”, issued by the Competition Council.

At the local level, the Competition Council organized 39 de events on promoting the

competition culture, focused on competition and State aid issues, as follows:

· 19 seminars organized by the Territorial Competition Inspectorates Alba, Bihor,

Braºov, Bucharest and the Ilfov County, Buzãu, Caraº-Severin, Dolj, Galaþi, Iaºi,Maramureº, Mureº, Prahova, Sibiu, Suceava and Vaslui; 15 of these seminars were carried out in collaboration with the local chambers of commerce, local authorities and professional associations;

· 12 round tables regarding the applicable rules in the competition and State aid field,

organized by the de Territorial Competition Inspectorates Braºov, Covasna, Iaºi, Gorj, Maramureº, Olt, Sibiu, Teleorman and Vrancea; 3 of these round tables were organized together with certain associations of the business environment, universities, as well as with the support of the local authorities;

· 8 working meetings and workshops organized by the Territorial Competition

Inspectorates Bacãu, Braºov, Dolj, Teleorman, Sibiu and Vaslui; at these actions attended representatives of the local business environment, as well as of the local authorities.

In addition, experts within the Territorial Competition Inspectorates Bacãu, Braºov, Dolj,

Teleorman, Sibiu and Vaslui attended 9 seminars and working meetings organized by other

institutions. Among the approached issues we mention: the State aid from the perspective of the EU accession; the responsibilities of the local authorities as well as of the undertakings to observe the State aid rules; the reporting and the monitoring of the State aids; the presentation of the competition and State aid legislation.

COMPETITION ADVOCACY


Consiliul Concurenþei a acordat în continuare o deosebitã atenþie perfecþionãrii profesionale a

personalului propriu în scopul creºterii eficienþei pentru aplicarea la standarde comunitare a

legislaþiei în domeniul concurenþei ºi ajutorului de stat.

Programul de pregãtire a personalului de specialitate s-a concretizat în participarea la acþiuni organizate atât în þarã, cât ºi în exterior: seminarii, conferinþe, vizite de lucru, stagii de pregãtire.

· Reuniunea Comitetului Consultativ în domeniul ajutorului de stat, 9 noiembrie, Bruxelles;

· Reuniunea Grupului de lucru privind concentrãrile economice, 13 noiembrie, Bruxelles;

· Lucrãrile ICN Cartel Workshop, 13-16 noiembrie, Haga;

Lucrãrile s-au axat pe dezbaterea interactivã a unor aspecte strategice ºi practice cu care se confruntã autoritãþile de concurenþã cu ocazia investigãrii ºi soluþionãrii unui caz de cartel.Acest eveniment a reprezentat un bun prilej pentru schimb de experienþã ºi de cunoºtinþe în domeniul punerii în aplicare a reglementãrilor anticartel între membrii Reþelei Internaþionale de Concurenþã.

· Vizitã de studiu organizatã în cadrul Proiectului de Twinning „Atingerea la data aderãrii a unei capacitãþi administrative ºi de aplicare a acquis-ului comunitar în domeniul concurenþei ºi ajutorului de stat corespunzãtoare unui Stat Membru”, 13-17 noiembrie, Bruxelles;

Obiectivul principal al acestei acþiuni l-a constituit familiarizarea cu ultimele evoluþii la nivel comunitar în domeniul ajutorului de stat atât a experþilor din cadrul Consiliului Concurenþei, cât ºi a judecãtorilor de la Înalta Curte de Casaþie ºi Justiþie ºi Curtea de Apel Bucureºti.

Programul vizitei de studiu a cuprins numeroase întâlniri cu reprezentanþi ai Misiunii Permanente a României pe lângã Uniunea Europeanã, Reprezentanþei Permanente a Marii Britanii, Direcþiei Generale Concurenþã, Direcþiei Generale pentru Politicã Regionalã ºi Serviciului Juridic al Comisiei Europene.

În data de 15 noiembrie, delegaþia s-a deplasat la Luxemburg pentru a lua parte la discuþii cu experþi din cadrul Curþii de Primã Instanþã ºi pentru a participa la o audiere a unui caz de ajutor de stat.

· Vizitã de lucru la Autoritatea de Concurenþã din Turcia, 15-18 noiembrie;

· Seminarul TAIEX cu tema Cerinþe IT în cadrul ECN, 15 noiembrie, Bruxelles;

· Reuniunea Comitetului Consultativ pentru ajutor de stat în vederea discutãrii proiectului de Regulament privind aplicarea procedurii de minimis în domeniul ajutorului de stat, 16 noiembrie, Bruxelles;

· Reuniunea de planificare a activitãþilor ce vor fi organizate în 2007 de cãtre Centrul Regional pentru Concurenþã (CRC) al OCDE, 16 noiembrie, Budapesta;


PREGÃTIRE PROFESIONALÃ

The Competition Council granted a special attention for the professional training of its personnel in order to improve the efficiency in enforcing at the Community standards the competition and State aid legislation.

The training programme of the specialty personnel was concretized in the participation at certain actions organized in Romania, as well as outside the country: seminars, conferences, working visits, training internships.

· Reunion of the Consultative Committee in the field of State aid,

November, 9, Bruxelles;

· Reunions of the Working Group on Economic Concentrations, November, 13,

Bruxelles;

· ICN Cartel Workshop, November, 13-16 Haga;

The works were focused on an interactive debate regarding certain strategic aspects, also

connected with the practice in the field, related to the approaches of the competition

authorities in investigating and handling a cartel case.

This event was a good opportunity for exchanging knowledge and experience within the

members of the International Competition Network.

· Working visit organized within the Twinning Project “Advancing the administrative

capacity and application of the acquis in the competition and State aid area, coherent

with the Member State status at the date of accession”, November, 13-17, Bruxelles;

The main objective of this action was the acquaintance with the latest developments at the

Community level of the Competition Council's experts, as well as of the judges within the High

Court of Cassation and Justice and the Bucharest Court of Appeal.

The programme of the working visit enclosed numerous meetings with the representatives of:

the Romania's Permanent Mission to the European Union, the Great Britain's Permanente

Mission, the General Directorate Competition, the Regional Policy Directorate-General and of

the Legal Service of the European Commission.

On November, 15 the delegation was in Luxemburg in order to participate at certain

discussions with the experts within the Court of First Instance and to attend a hearing in a State

aid case.

· Working visit at the Turkish Competition Authority, November, 15-18;

· TAIEX seminar on IT Requirements within the ECN, November, 15, Bruxelles;

· Reunion of the Consultative Committee on State aid focused on debating the draft

Regulation for the application of the de minims procedure in the field of State aid,

November, 16, Bruxelles;

· Reunion for planning the activities following to be organized in 2007 by the OECD

Competition Regional Center (CRC), November, 16, Budapest;


PROFESSIONAL TRAINNING


Agenda reuniunii a acoperit douã teme principale de dezbatere:

- relaþia dintre reglementatori ºi autoritãþile de concurenþã;

- programele de formare profesionalã ce vor fi organizate în 2007 de cãtre CRC ºi noua structurã a acestor programe.

Modernizarea activitãþii CRC - prin promovarea unor noi programe de formare profesionalã pentru autoritãþile de concurenþã din regiune ºi a schimbului de experienþã în aplicarea regulilor de concurenþã - are ca scop stimularea unei participãri active ºi eficiente a autoritãþilor de concurenþã din regiune, precum ºi îmbunãtãþirea ºi convergenþa aplicãrii regulilor de concurenþã în regiune.

· Stagiu de pregãtire la Autoritatea de Concurenþã din Portugalia, 20-24 noiembrie;

· În cadrul noului Proiect de Twinning a avut loc seminarul pe fonduri structurale, susþinut de doamna Hanne Hoeck - expert în domeniul Fondurilor structurale, 20 - 22 noiembrie, sediul Consiliului Concurenþei;

Seminarul a conferit experþilor Consiliului Concurenþei, responsabili cu schemele de ajutor de stat incluse în programele operaþionale, posibilitatea de a obþine clarificãrile dorite pentru fiecare schemã în parte.

· Seminar, organizat de Institutul European din România, privind pregãtirea specialiºtilor români pentru concursurile de angajare în instituþiile europene, 20-22 noiembrie;

· Seminar, în cadrul Proiectului de Twinning, privind noua legislaþie în domeniul ajutorului de stat la nivel comunitar, 23 noiembrie, sediul Consiliului Concurenþei;

Acest seminar a fost susþinut de domnul Graham Branton, DTI Director State Aid Department. În cadrul seminarului au avut loc ºi dezbateri referitoare la introducerea conceptului Analiza de Impact a Reglementãrii (AIR) în domeniul ajutorului de stat.

· Conferinþa Forumului Bancar Român, 27 noiembrie, Hotel Marriott;

· Reuniunea ECN a Comitetului Consultativ privind practicile anticoncurenþiale ºi poziþia dominantã, 27 noiembrie, Bruxelles;

Au avut loc dezbateri privind aplicarea legislaþiei comunitare ºi revizuirea Notei Comisiei privind imunitatea la amenzi ºi reducerea acestora în cazurile de cartel din 2002, precum ºi elaborarea documentului comunitar ECN Leniency Model.

· Întâlnirea reprezentanþilor autoritãþilor naþionale de concurenþã ºi reglementare ocazionatã de Ziua Energiei, 30 noiembrie, Bruxelles.

Secþiunea I, prezidatã de domnul Philip Lowe, Director General în cadrul Direcþiei Generale Concurenþã, a fost dedicatã dezbaterii proiectului Raportului final privind ancheta în domeniul energiei.

The two main points of the reunion's agenda were:

- the relation between the regulators and the competition authorities;

- the training programmes following to be organized by CRC and the new structure of these programmes.

The CRC's modernization - by promoting new training programmes for the competition authorities within the region and the exchange of experience in enforcing the competition rules - has the scope of stimulating an active and efficient participation of the competition authorities within the region, as well as the improvement and the convergence in enforcing competition rules within the region.

· Training internship at the Portuguese Competition Authority, November, 20-24;

· Seminar on the Structural Funds, chaired by de Mrs. Hanne Hoeck - expert on the Structural Funds, organized within the new Twinning Project, November, 20 - 22, the headquarters of the Competition Council;

The seminar offered, for the experts within the Competition Council responsible with the State aid schemes included by the Operational Programmes, the opportunity to be clarified in respect to the specific issues of each scheme.

· Seminar, organized by the European Institute from Romania, intended for training the Romanian specialists whishing to get hired by the European institutions, November, 20-22;

· Seminar, within the Twinning Project on the new Community legislation in the State aid field, November, 23, the headquarters of the Competition Council;

This seminar was chaired by Mr. Graham Branton, DTI Director State Aid Department. Within the seminar debates were carried out regarding the introduction of the Regulatory Impact Analysis (RIA) concept in the field of State aid.

· Conference of the Romanian Bank Forum, November, 27, Hotel Marriott;

With this occasion were carried out debates on enforcing the Community legislation and the revision of the 2002 European Commission Notice on immunity from fines and reduction of fines in cartel cases, as well as the elaboration of the Community document ECN Leniency Model.

· Meeting of the representatives of the national competition authorities and of the national regulatory authorities with the occasion of the Energy Day, November, 30, Bruxelles.

The first section, chaired by Mr. Philip Lowe, General Director within DG Competition, was focused on debating the draft Final Report on the inquiry in the field of energy.

În cursul lunii noiembrie a fost declanºatã o investigaþie ca urmare a unei sesizãri formulatã de

mai multe societãþi comerciale referitoare la un eventual abuz de poziþie dominantã sãvârºit de Compania Naþionalã Poºta Românã SA pe piaþa serviciilor de publicitate prin poºtã.

Consiliul Concurenþei a emis 9 decizii, din care 8 decizii în domeniul concurenþei ºi o decizie în domeniul ajutorului de stat, astfel:

· 1 decizie de respingere a unei plângeri

Plângerea a fost formulatã de un grup de societãþi împotriva Biroului Vamal Constanþa Sud cu privire la blocarea stocurilor de marfã existente în depozitul din Zona liberã Constanþa Sud ºi interzicerea comercializãrii bãuturilor alcoolice mãrcile Jack Daniel's, Finlandia ºi Southern Comfort. Aspectele semnalate nu au prezentat suficiente temeiuri de fapt ºi de drept pentru a justifica intervenþia Consiliului Concurenþei (Decizia nr.216/6.11.2006).

· 2 decizii de sancþionare privind omisiunea notificãrii unor operaþiuni de concentrare economicã

Societãþile Procema SA Bucureºti ºi Unimat SRL Sibiu au fost sancþionate cu amendã de , respectiv în cazul concentrãrii economice realizatã prin

înfiinþarea societãþii în comun concentrative Procema-Unimat SRL Sibiu (Decizia nr.217/10.11.2006 ºi Decizia nr.218/10.11.2006 ).

· 5 decizii privind autorizarea unor concentrãri economice

Deciziile de autorizare au fost emise pentru concentrãrile economice realizate prin: - Preluarea controlului unic de cãtre Kardan NV asupra Kardan Financial

Services BV ºi indirect asupra TBI Leasing, TBI Credit ºi TBI Insurance Agent de Asigurare (Decizia nr.219/13.11.2006);

- Dobândirea controlului în comun asupra Imobilia Credit IFN SA de cãtre Raiffeisen Bank SA ºi Impact Developer & Contractor SA (Decizia nr.220/20.11.2006);

- Preluarea controlului unic de cãtre societatea Realitatea Media SA asupra Grupului de firme Caþavencu (Decizia nr.221/20.11.2006);

- Fuziunea prin absorbþie a Grupului Suez de cãtre Grupul Gaz de France (Decizia nr.223/29.11.2006);

- Înfiinþarea de cãtre societãþile SC Procema SA Bucureºti ºi SC Unimat SRL ªelimbãr a unei societãþi în comun Procema-Unimat SRL Sibiu (Decizia nr.224/29.11.2006).

· 1 decizie privind stoparea acordãrii de ajutoare de stat regionale pentru un numãr

de 35 de operatori economici care activeazã în zonele defavorizate ºi care au atins

limita maxim admisã a ajutorului de stat.

During November an investigation was initiated following a complaint formulated by a series of

undertakings, having as object the possible abuse of the dominant position of the National Company Romanian Post on the market of mail advertising.

The Competition Council issued Cons 9 decisions, of which 8 decisions in the competition field and one decision in the field of State aid, as follows:

· 1 decision for rejecting a certain complaint

The complaint was formulated by a group of undertakings against the Constanþa Sud Customs Office regarding the blocking of the stocks of merchandises from the deposit situated within the Constanþa Sud Free Trade Area and the interdiction to commercialize alcoholic beverages of the Jack Daniel's, Finlandia and Southern Comfort brands. The issues brought into the attention of the Competition Council did not present sufficient grounds in fact or in right to justify the intervention of the Competition Council (Decision no.216/6.11.2006).

· 2 sanctioning decisions for the failure to notify certain operations of economic concentration

The undertakings Procema SA Bucharest and Unimat SRL Sibiu were sanctioned with a fine of , respectively in the case of the economic concentrations

carried out by establishing the joint concentrative company Procema-Unimat SRL Sibiu (Decision no.217/10.11.2006 and Decision no.218/10.11.2006).

· 5 authorizing decisions of economic concentrations

The authorizing decisions were issued for the economic concentrations carried out by: - Acquiring sole control by Kardan NV over Kardan Financial Services BV and

indirectly over TBI Leasing, TBI Credit and TBI Insurance Agent de Asigurare (Decision no.219/13.11.2006);

- Acquiring joint control over Imobilia Credit IFN SA by Raiffeisen Bank SA and Impact Developer & Contractor SA (Decision no.220/20.11.2006);

- Acquiring sole control by Realitatea Media SA over the Group of firms Caþavencu (Decision no.221/20.11.2006);

· 1 decision regarding the stopping of granting of regional State aids for 35 economic operators activating in the deprived areas, which have reached the maximum limit of the State aid intensity.

În luna noiembrie, Consiliul Concurenþei a publicat Raportul privind rezultatele acþiunii de

monitorizare a ajutoarelor de stat regionale acordate agenþilor economici cu certificat

de investitor în zonele defavorizate.

Acþiunea de monitorizare a fost întreprinsã în perioada august - octombrie 2006, în cadrul

acesteia fiind evaluate ajutoarele de stat regionale de care au beneficiat agenþii economici

începând cu data de 2 ianuarie 2003, precum ºi costurile eligibile aferente investiþiilor

realizate pânã la data de 15 septembrie 2004. Numãrul total al agenþilor economici

verificaþi, care au certificat permanent de investitor în zonele defavorizate, a fost de 1.393.

Valoarea totalã a investiþiilor realizate pânã la 15 septembrie 2004 în zonele

defavorizate pentru achiziþii de terenuri, construcþii de clãdiri, hale industriale, echipamente ºi

utilaje, precum ºi pentru maºini necesare desfãºurãrii activitãþii în zonã, a fost de 1.804 mil.

lei noi. Valoarea ajutorului de stat sub forma scutirii impozitului pe profit, de care au

beneficiat agenþii economici în perioada 2003-semestrul I 2006, a fost de 208,8 mil. lei, iar

a ajutorului sub forma fondurilor nerambursabile a însumat 4,4 mil. lei noi.

Ajutoarele pentru crearea de locuri de muncã s-au ridicat la 1,9 mil. lei noi ºi, împreunã

cu ajutoarele pentru investiþii, au avut ca efect crearea unui numãr de circa 51.500 locuri de

muncã.

Din numãrul total de 1.393 agenþi economici verificaþi, vor putea beneficia în continuare de

ajutor de stat 1.318, restul încadrându-se într-una din situaþiile:

- 35 agenþi economici au atins limita maxim admisã a intensitãþii ajutorului de

stat ºi, ca urmare, nu vor mai beneficia de ajutor de stat;

- pentru 19 agenþi economici Agenþiile de Dezvoltare Regionalã au retras

certificatele de investitor datoritã neîndeplinirii condiþiilor legale de a mai beneficia de ajutor de stat;

- 13 agenþi economici au înstrãinat investiþiile realizate pânã la 15 septembrie 2004; agenþii economici respectivi nu au beneficiat de ajutor de stat pânã în prezent;

- 4 agenþi economici nu mai desfãºoarã activitate în zonele defavorizate;

- 3 firme au intrat în procedura de lichidare judiciarã sau faliment;

- un agent economic ºi-a încetat activitatea în zonele defavorizate ºi a fost radiat de la Registrul Comerþului.

Ca urmare controlului efectuat s-a constatat cã valoarea ajutoarelor de stat ce se mai poate

acorda agenþilor economici cu certificat de investitor în cele 28 de zone defavorizate

care continuã ºi dupã 2007, este de circa 795 mil. lei noi, reprezentând aproximativ 225 mil. euro, având în vedere cursul mediu pe semestrul I al anului 2006.

Ca efect al controalelor repetate ale Consiliului Concurenþei ºi datoritã înºtiinþãrii agenþilor

economici asupra sumelor de care mai pot beneficia, în aceastã acþiune de monitorizare nu s-a

înregistrat niciun agent economic care sã fi depãºit nivelul maxim admis al intensitãþii

ajutorului.

Pentru cei 35 agenþi economici care au atins pragul maxim admisibil al intensitãþii,

Consiliul Concurenþei a emis Decizia nr.222/28.11.2006 privind stoparea acordãrii de

ajutoare de stat.

In November, the Competition Council published the Report on the monitoring regional State aids granted to the undertakings having investor certificates in deprived areas.

The monitoring action was carried out during August - October 2006 and it envisaged the assessment of the regional State aids received by the undertakings beginning with 2 January 2003, as well the eligible costs related to the investments made until 15 September 2004. The total number of the undertakings verified having permanent investor certificates in the deprived areas was of 1,393.

The total amount of the investments made in deprived areas until 15 September 2004 for land acquisitions, buildings, industrial halls, equipments and installations, as well as machines for carrying on the activity in the area was of RON 1,804 million. The value of the State aid in the form of profit tax exemption, from which the undertakings benefited during 2003 - first semester of 2006 was of RON 208.8 million and the value of the State aid in the form of non-refundable founds was of RON 4.4 million.

The State aid for job creation was of RON 1.9 million and together with State aid for investments they had as an effect the creation of about 51,500 jobs.

1,318 of the total number of 1,393 checked undertakings can further benefit from State aid, the other undertakings being in one of the following situations:

- 35 undertakings reached the maximum admissible limit of the State aid

intensity and therefore they would no further benefit from State aid;

- for 19 undertakings the Agencies for Regional Development withdrawn the investor

certificates because they did not fulfill the legal requirements in order to benefit from State aid;

- 13 undertakings alienated investments made until 15 September 2004 and therefore they are not eligible to receive State aid anymore; this undertakings did not benefit from State aid before;

- 4 undertakings do not carry on activity in the deprived areas any more;

- 3 undertakings entered judicial liquidation or bankruptcy procedures;

- 1 undertaking ceased its activity in the deprived area, being erased from the Trade Register.

Pursuant to the control undertaken, it has came out that the value of the State aid that can be further granted to the undertakings having investor certificate in the 28 deprived areas that goes on after 2007 is about RON 795 million, which means about EUR 225 million at the medium exchange rate of the first semester 2006.

As a result of the repeated controls undertaken by the Competition Council and of the informing actions of the undertakings regarding the amounts they can further benefit from, during this monitoring action no undertaking exceeding the maximum admissible level of the State aid intensity has been registered. For the 35 undertakings which reached the maximum admissible limit of the intensity, the Competition Council issued the Decision no.222/28.11.2006 regarding the stopping of State aid granting.

Consiliul Concurenþei a emis 8 avize, din care 4 avize în domeniul concurenþei ºi 4 avize în

domeniul ajutorului de stat, a formulat un punct de vedere ºi a transmis 10 adrese conþinând

clarificãri pe diverse probleme în domeniul ajutorului de stat.

· Aviz favorabil condiþionat de modificarea unor prevederi din proiectul de Hotãrâre a Consiliului General al Municipiului Bucureºti, pentru modificarea tarifelor de ruinare ºi excesive prevãzute prin HCGMB nr.169/19.06.2003 privind stabilirea numãrului maxim de autorizaþii ºi a condiþiilor necesare pentru asigurarea continuitãþii serviciilor de transport în regim de taxi pe teritoriul Municipiului Bucureºti;

· Aviz favorabil, la solicitarea Ministerului Transporturilor, Construcþiilor ºi Turismului, referitor la proiectul de Ordonanþã de Urgenþã privind modificarea ºi completarea Ordonanþei de Urgenþã a Guvernului nr.12/1998 privind transportul pe cãile ferate române ºi reorganizarea Societãþii Naþionale a Cãilor Ferate Române, republicatã, cu modificãrile ºi completãrile ulterioare;

· Aviz favorabil referitor la proiectul de Hotãrâre a Guvernului pentru aplicarea de la data aderãrii la UE a Regulamentului Consiliului nr.1980/2000/CEE privind sistemul revizuit a etichetei ecologice comunitare;

· Aviz favorabil referitor la proiectul de Lege privind controlul ºi conduita personalului cu atribuþii de control.

Ajutor de stat

· Aviz favorabil condiþionat referitor la proiectul de Hotãrâre a Guvernului pentru modificarea anexei nr. 1 la Hotãrârea Guvernului nr.462/2006 pentru aprobarea programului „Termoficare 2006-2009 calitate ºi eficienþã” ºi înfiinþarea Unitãþii de management al proiectului;

· Aviz favorabil condiþionat referitor la proiectul de Hotãrâre de Guvern pentru aprobarea Studiului de fezabilitate precum ºi a indicatorilor tehnico-economici ai obiectivului de investiþii „Îmbunãtãþirea gospodãririi ºi siguranþei iazurilor de decantare ºi a haldelor de steril de la mina Roºia Poieni”;

· Aviz favorabil condiþionat referitor la proiectul de Hotãrâre a Guvernului privind garantarea de cãtre Ministerul Finanþelor Publice în proporþie de 80% a împrumutului în valoare de maximum 190 milioane de dolari S.U.A. pentru SC Electrocentrale Bucureºti SA, în vederea completãrii finanþãrii achiziþiilor de resurse energetice din þarã ºi din import pentru iarna 2006-2007;

· Aviz favorabil condiþionat referitor la proiectul Legii investiþiilor.

Binding opinions, points of view, clarifications

The Competition council issued 8 binding opinions, of which 4 binding opinions in the field of competition and 4 binding opinions in the field of State aid, formulated one point of view and transmitted 10 letters containing clarifications on various State aid issues.

By the binding opinions issued by the Competition Council is envisaged the concordance of the provisions of the normative acts with the competition and State aid legislation. For the draft normative acts requiring amendments of certain provisions were issued 5 favorable binding opinions with conditions in the field of competition and 4 in the State aid field.

Competition

· Favorable binding opinion under the condition of modifying certain provisions of the Draft Decision of the General Council of the Bucharest Municipality for the amendment of the excessive and predatory tariffs established by the Decision of the General Council of the Bucharest Municipality no.169/19.06.2003 regarding the setting out of the maximum number of authorizations and of the necessary conditions for providing the continuity of the taxi transportation services on the territory of the Bucharest Municipality;

· Favorable binding opinion, at the request of the Ministry of Transports, Constructions and Tourism, regarding the draft Emergency Government Ordinance on amending and completing the Emergency Government Ordinance no.12/1998 regarding the transport on the Romanian railways and the reorganization of the National Company of the Romanian Railways, republished, with the subsequent amendments and completions;

· Favorable binding opinion regarding the draft Government Decision for the application from the date of the EU accession of the Council Regulation no.1980/2000/CEE on a revised Community eco-label award scheme;

· Favorable binding opinion regarding the draft Law on the control and the behavior of the personnel having attributions of control.

State aid

· Favorable binding with conditions on the draft Government Decision for the amendment of Annex no.1 of the Government Decision no.462/2006 for approving the program “Heating 2006-2009 quality and efficiency” and the establishment of the Management Unit for this project;

· Favorable binding with conditions regarding the draft Government Decision for approving the Feasibility Study and the technical and economical indexes of the investment objective “The improvement of the management and the safety of the decantation ponds and of the dumps of sterile from the mine Roºia Poieni”;

Ca urmare a solicitãrii primite din partea Guvernului României - Departamentul pentru Relaþia cu Parlamentul, Consiliul Concurenþei a formulat un punct de vedere referitor la propunerea legislativã pentru stabilirea criteriilor de bazã a taxelor ºi tarifelor aferente elaborãrii, analizei ºi verificãrii documentaþiilor cadastrale pentru înscrierea în Cartea Financiarã a titlurilor de proprietate ºi pentru scoaterea terenurilor extravilane din circuitul agricol.

Dialogul permanent purtat cu alte autoritãþi sau cu agenþii economici s-a concretizat în transmiterea a 10 adrese de clarificare în domeniul ajutorului de stat cãtre:

· Autoritatea pentru Valorificarea Activelor Statului privind procedura de aplicare în cazul schemei de ajutor de stat de minimis acordat întreprinderilor în cadrul procesului de valorificare a activelor statului;

· Consiliul Judeþean Vâlcea cu privire la obligaþia notificãrii intenþiei de a se acorda sprijin financiar Regiei Autonome Judeþene de Drumuri ºi Poduri Vâlcea pentru mãsurile de protecþie socialã de care va beneficia personalul disponibilizat;

· Ministerul Administraþiei ºi Internelor cu privire la proiectul schemei de ajutor de stat conþinutã de Ordonanþa Guvernului nr.36/2006 privind compensarea pierderilor înregistrate ca urmare a prestãrii serviciilor de interes economic general de cãtre societãþile care produc, transportã, distribuie ºi furnizeazã energie termicã;

· Ministerul Agriculturii, Pãdurilor ºi Dezvoltãrii Rurale cu privire la proiectul de Hotãrâre a Guvernului pentru stabilirea speciilor ºi a valorii ajutorului financiar, pentru producþia internã de seminþe ºi material sãditor, certificatã oficial, în anii 2006 ºi 2007, destinatã pentru însãmânþare sau plantare în campaniile agricole din anii de vânzare 2006/2007 ºi 2007/2008 ºi pentru aprobarea Normelor metodologice privind acordarea, verificarea ºi plata ajutorului financiar;

· Ministerul Administraþiei ºi Internelor cu privire la Nota de fundamentare ºi proiectul de Hotãrâre a Guvernului pentru contractarea unor împrumuturi interne cu garanþia statului de cãtre unii operatori economici ai autoritãþilor administraþiei publice locale, producãtori de energie termicã în sistem centralizat;

· Ministerul Muncii, Solidaritãþii Sociale ºi Familiei cu privire la Memorandumul având ca tematicã ,,Elaborarea unui act normativ care sã prevadã mãsuri speciale de protecþie socialã pentru persoanele ce urmeazã a fi disponibilizate prin concedieri colective dupã data de 1 ianuarie 2007”;

· Guvernul României - Departamentul pentru Relaþia cu Parlamentul cu privire la propunerea legislativã privind aprobarea unor mãsuri financiare pentru societãþile comerciale din industria berii;

· Casa Naþionalã de Pensii ºi Alte Drepturi de Asigurãri Sociale (CNPAS)cu privire la vânzarea cãtre LNM Holdings NV a unor acþiuni rezultate din conversia în acþiuni a anumitor obligaþii ale SC SIDEX SA cãtre CNPAS;

· Ministerul Transporturilor, Construcþiilor ºi Turismului cu privire la plângerea societãþii FDEE Electrica Muntenia Nord SA Ploieºti împotriva Companiei Naþionale CFR SA;

· Ministerul Sãnãtãþii Publice cu privire la intenþia Ministerului Finanþelor Publice de a finanþa Programul de evaluare a stãrii de sãnãtate a populaþiei.

Following the request of the Romanian Government - Department for the Relation with the Parliament, the Competition Council formulated a point of view regarding the legislative proposal for establishing the basic criteria in respect to the taxes and tariffs for the elaboration, analysis and verification of the cadastral documentations for registering in the Land Register the property titles and for the removal of the lands situated outside the localities from the agricultural circuit.

The permanent dialogue carried out with other authorities and with undertakings was concretized in the transmission of 10 letters containing clarifications in the field of State aid, which were transmitted to:

· Authority for State Assets Recovery regarding the application procedure in the case of the de minimis State aid scheme granted for the undertakings within the process of capitalizing the State's assets;

· County Council of Vâlcea regarding the obligation to notify the intention to grant financial support in favor of the Autonomous Regie of Roads and Bridges Vâlcea for the measures of social protection of which will beneficiate the dismissed personnel;

· The Ministry of Administration and Interior regarding the draft State aid scheme contained by the Government Ordinance no.36/2006 on compensating the losses registered following the discharging the services of general economic services by the undertakings producing, transporting, distributing and supplying heating energy;

· The Ministry of Agriculture, Forests and Rural Development on the draft Government Decision for establishing the classes and the value of the financial aid for the official certified internal production of seeds and engraining material, for 2006 and 2007, intended for sowing or planting in the agricultural campaigns of the years of the sale 2006/2007 and 2007/2008 and for approving the Methodological Norms regarding the grant, verification and payment of the financial aid;

· The Ministry of Administration and Interior regarding the Reasoned Note and the Draft Government Decision for contracting certain loans from internal resources with the State's guarantee by certain economic operators of the local administrations, producers of heating energy in centralized system;

· The Ministry of Labor, Social Solidarity and Family regarding the Memorandum on ”Elaborating a normative act providing special measures of social protection for the

stpersonnel following to be dismissed through collective dismissals after the 1 of January 2007”;

· Romanian Government - Department for the Relation with the Parliament regarding the legislative proposal on approving certain financial measures for the trading companies operating in the bear industry;

· National House of Pensions and Other Social Insurance Rights (NHPOS) regarding the commercialization to LNM Holdings NV of certain actions resulted from the conversion in actions of certain obligations of SC SIDEX SA to NHPOS;

Întâlnire de lucru

Experþi din cadrul Consiliului Concurenþei au participat, în ziua de 1 noiembrie, la cea de-a doua

reuniune a Grupului Interinstituþional privind Sursele Regenerabile de Energie, Eficienþã

Energeticã ºi Biocombustibili, organizatã de Ministerul Integrãrii Europene ºi Ministerul Economiei ºi Comerþului, la sediul MIE. Întâlnirea a reunit ºi reprezentanþi din partea Ministerului Mediului ºi Gospodãririi Apelor ºi Ministerului Agriculturii, Pãdurilor ºi Dezvoltãrii Rurale. Tema întâlnirii a constituit-o proiectul de concluzii ale Consiliului Uniunii Europene referitor la Planul de Acþiune privind Eficienþa Energeticã al CE.

Reuniunea desfãºuratã în data de 15 noiembrie 2006 la sediul Consiliului Concurenþei a avut ca temã modalitatea de raportare ºi monitorizare a ajutoarelor fiscale. La întâlnirea organizatã la sediul Consiliului Concurenþei pe 30 noiembrie a participat, alãturi de reprezentanþi din partea ministerelor, ºi un reprezentant de la Secretariatul Permanent pentru Afaceri Europene.Au fost supuse dezbaterilor probleme privind societãþile în care statul este reprezentat de ministere; rolul reprezentanþilor ministerelor în conducerea acestor societãþi; rolul ºi activitatea Consiliului de Supraveghere din domeniul feroviar.Activitatea Consiliului Concurenþei s-a reflectat în 232 de apariþii în presa centralã, dintre care 125 apariþii au avut ca sursã Consiliului Concurenþei, iar 107 apariþii au fost din alte surse.

Working meeting

stExperts witin the Competition Council attended on the 1 of November the second reunion of

the Inter-institutional Group on Renewable Energy Resources, Energetic Efficiency and

Biofuels, organized by the Ministry of European Integration and the Ministry (MEI) of Economy and Commerce at the de MEI's headquarters. The meeting was also attended by the representatives of the Ministry of Environment and Waters Management and the Ministry of Agriculture, Forests and Rural Development. The meeting was focused on the draft conclusions of the Council of the European Union regarding the Action plan on the Energetic Efficiency of the EC.

The reunion carried out on November, 15 at the headquarters of the Competition Council was focused on the manner of reporting and monitoring the fiscal aids. The debated were attended by representatives of: the Ministry of Communications and Technology Information, the Ministry of Economy and Commerce, the Ministry of Public Finances, the National Agency for the Occupation of the Labor Force, the Ministry of Labor, Social Solidarity and Family and the Ministry of Administration and Interior.

În data de 27 noiembrie, domnul Mihai Berinde, Preºedintele Consiliului Concurenþei, a participat la emisiunea Closing Bell a postului TV The Money Channel. În luna noiembrie, Consiliul Concurenþei a transmis 14 comunicate de presã.

În luna noiembrie, au fost publicate 30 de articole cu privire la concurenþã ºi ajutor de stat, astfel: câte un articol în presa judeþelor: Bihor, Botoºani, Buzãu, Caraº-Severin, Galaþi, Gorj, Olt, Prahova, Teleorman, Dolj ºi Vrancea; câte 2 articole în presa judeþelor Dolj ºi Sãlaj; câte 3 articole în presa judeþelor: Dâmboviþa, Maramureº ºi Mureº; câte 4 articole în presa judeþelor Braºov ºi Sibiu.

Totodatã, 2 articole au fost transmise cãtre agenþiile de presã.
