PRECIZARI METODOLOGICE

Operator economic reprezintã organizaþia (pluripersonalãsau unipersonalã) cu personalitate juridicã creatã pentru adesfãºura activitãþi definite în baza Legii nr. 15 / 1990, a Legii nr. 31 / 1990 cu modificãrile ulterioare ºi a Legii nr. 300 / 2004.

Operator social reprezintã organizaþia (pluripersonalã sauunipersonalã) cu personalitate juridicã, creatã pentru adesfãºura o activitate dedicatã interesului social.

Unitate legalã reprezintã orice operator economic sausocial care dispune de un patrimoniu propriu, poate sã încheie înnume propriu contracte cu terþi ºi sã-ºi apere interesele înjustiþie - are personalitate juridicã. Unitãþile legale sunt fiepersoane fizice sau asociaþii familiale (în calitatea lor deîntreprinzãtori), fie persoane juridice.

Registrul Statistic (REGIS) reprezintã un instrumentstatistic de evidenþã a datelor de identificare ºi a unor indicatorieconomici principali pentru toate unitãþile legale, caredesfãºoarã o activitate economicã sau socialã. Registrul esteactualizat pe baza urmãtoarelor surse:– Registrul Fiscal;– Registrul Comerþului;– Bilanþul contabil al operatorilor economici;– Bilanþul contabil al organizaþiilor neguvernamentale;– Date ºi informaþii furnizate de Autoritatea pentru

Privatizare ºi Administrarea Participaþiilor Statului ºi deBanca Naþionalã a României;

– Cercetãri statistice organizate de Institutul Naþional deStatisticã.Întreprinderea1) este o grupare de unitãþi legale care se

constituie ca o entitate organizaþionalã de producþie de bunuri,servicii comerciale, sau servicii de interes social, ce beneficiazãde o autonomie de decizie, mai ales pentru asigurarea resurselorsale curente.

O întreprindere exercitã una sau mai multe activitãþi, în unulsau mai multe locuri (sedii - unitãþi locale ale întreprinderii). Înmod convenþional sunt asimilate întreprinderilor, persoanelefizice ºi asociaþiile familiale care desfãºoarã activitãþi economicepe bazã de liberã iniþiativã potrivit legii, instituþiile publice ºiorganizaþiile neguvernamentale.

Unitatea localã1) este o întreprindere sau o parte a acesteia(atelier, fabricã, depozit, birou, minã sau staþie etc.) situatã la oadresã identificabilã.

În acest loc se desfãºoarã o activitate economicã, pentrucare - în afara unor cazuri excepþionale - lucreazã una sau maimulte persoane (cu normã întreagã sau parþialã) pentru aceeaºiîntreprindere.

Întreprinderea activã este entitatea care, din punct devedere economic, este activã în perioada de observare, respectivrealizeazã bunuri sau servicii, înregistreazã cheltuieli ºiîntocmeºte bilanþ contabil.

Întreprinderea dormantã este entitatea care existã juridic,dar este inactivã, din punct de vedere economic, în perioada deobservare.

METHODOLOGICAL NOTES

Economic operator represents an organisation (consisting ofone or several persons) with legal personality created in order tocarry out certain activities defined based on Law no. 15, on Law no.31/1990 with subsequent modifications and on Law no. 300 / 2004.

Social operator represents an organisation (consisting of oneor several persons) with legal personality, created in order to carryout an activity devoted to social interest.

Legal unit represents any economic or social operatordisposing of an own patrimony, which could conclude, on ownaccount, contracts with third parties and defend their interests injustice - has legal personality. Legal units are either natural personsor family associations (as entrepreneurs) or legal persons.

Statistical register (REGIS) represents a statistical instrumentfor records of identification data and for some main economicindicators for all legal units carrying out an economic or socialactivity. The register is updated based on the following sources:

– Fiscal Register;– Trade Register;– Balance sheets of economic operators;– Balance sheets of non-governmental organisations;– Information supplied by Authority for State Assets Privatisation

and Management and by the National Bank of Romania;

– Statistical surveys organised by the National Institute ofStatistics.Enterprise1) is the group of legal units set up as an

organisational entity producing goods, trading services or socialinterest services, enjoying decisional autonomy, particularly forensuring its current resources.

An enterprise is carrying out one or several activities, on one orseveral places (headquarters - local units of enterprises). Thenatural persons and the family associations carrying out economicactivities based on free initiative according to the law, the publicinstitutions and the NGOs are conventionally assimilated toenterprises.

The local unit1) is an enterprise or part thereof (workshop,factory, warehouse, office, mine or station a.s.o.) situated in ageographically identified place.

At this place an economic activity is carried out for which - savefor certain exceptions - one or more persons work (even if only part- time) for one and the same enterprise.

Active enterprise is the entity which, from economicstandpoint, is active during the survey period, that is, it producesgoods or services, records expenditure and draws up balancesheets.

Dormant enterprise is the entity existing from juridicalstandpoint, but inactive, from the economic standpoint, during thesurvey period.

În funcþie de principalele caracteristici ale comportamentului

lor economic, întreprinderile - în sensul larg al cuvântului -

se clasificã în urmãtoarele categorii:

– Întreprinderi cu activitate economicã nefinanciarã:

întreprinderi agricole; întreprinderi din industrie,

construcþii, comerþ ºi alte servicii;

– Întreprinderi financiare, bancare ºi de asigurãri;

– Instituþii din administraþia publicã centralã ºi localã ºi

instituþii din sfera securitãþii sociale;

– Organizaþii neguvernamentale - fãrã scop patrimonial;

– Întreprinzãtori privaþi - persoane fizice independente ºi

asociaþii familiale.

Întreprinderile - în sensul larg al cuvântului - dupã formele

juridice de organizare, sunt urmãtoarele:

– Regii autonome ºi institute naþionale înfiinþate prin

Hotãrâri guvernamentale sau ale administraþiei locale;

– Societãþi comerciale înfiinþate în baza Legii nr. 31 / 1990, cu

modificãrile ºi completãrile ulterioare, de tipul:

- societãþi în nume colectiv;

- societãþi în comanditã simplã;

- societãþi în comanditã pe acþiuni;

- societãþi pe acþiuni, inclusiv societãþi ºi companii

naþionale;

- societãþi cu rãspundere limitatã.

– Societãþi agricole înfiinþate sau reorganizate în baza Legii

nr. 36 / 1991;

– Societãþi cooperatiste reprezintã societãþile cu capital de

tip cooperatist înfiinþate sau reorganizate în baza Decretelor

- Lege nr. 66 / 1990, nr. 109 / 1996 ºi 1 / 2005;

– Alte instituþii ale administraþiei publice centrale ºi locale

înfiinþate prin decrete, legi;

– Instituþii bugetare înfiinþate prin hotãrâri de guvern sau

decizii ale organelor administraþiei locale;

– Întreprinzãtori privaþi - persoane fizice independente ºi

asociaþii familiale, înfiinþate în baza Legii nr. 300 / 2004;

– Organizaþii neguvernamentale - asociaþii ºi fundaþii,

sindicate, partide politice, organizaþii ale cultelor religioase

înfiinþate în baza Ordonanþei Guvernului nr. 26/2000 ºi Legii

nr. 21/1924.

Dupã forma juridicã de organizare, întreprinderile au

caracter comercial sau necomercial. În categoria formelor

juridice necomerciale sunt incluse instituþiile bugetare,

administraþia publicã centralã ºi localã, precum ºi organizaþiile

neguvernamentale.

În sfera economicã se includ formele juridice cu caracter

comercial: regii autonome ºi institute naþionale, societãþi

comerciale, societãþi cooperatiste, societãþi agricole. În aceastã

categorie nu se includ societãþile care desfãºoarã activitãþi cu

caracter social, respectiv activitãþile didactic-educative ºi de

asistenþã sanitarã. Aceste activitãþi nu sunt asimilate cu un act de

comerþ ºi nu pot conferi comercialitate societãþii care o

desfãºoarã.

According to the main characteristics of their economic

behaviour, enterprises - in the broad meaning of the word - are

classified in the following categories:

– Enterprises with non-financial economic activity:

agricultural holdings; enterprises from industry, construction,

trade and other services;

– Financial, banking and insurance companies;

– Institutions of central and local government and

institutions from social security field;

– Non-governmental organisations - non-patrimony purpose;

– Private entrepreneurs - comprising natural independent

persons and family associations.

Enterprises - in the broad meaning of the word - according to

juridical organisational types are the following:

– Autonomous companies and national institutes, created

on the basis of central or local government decisions;

– Commercial companies created on the basis of Law no. 31/

1990, with subsequent amendments, such as:

- partnerships;

- simple limited partnerships;

- joint-stock partnerships;

- joint-stock companies, including national societies and

companies;

- limited liability companies.

– Agricultural holdings created or restructured on the basis of

Law no. 36 / 1991;

– Co-operative companies represent the companies with co-

operative capital created or restructured on the basis of Decree

- Laws no. 66 / 1990, no. 109 / 1996 and 1 / 2005;

– Other institutions of government central and local

administration created on the basis of Decree, Laws;

– Budgetary institutions created on the basis of central or local

government decisions;

– Private entrepreneurs - natural independent persons and

family associations, created on the basis of Law no. 300 / 2004;

– Non-governmental organisations - associations and

foundations, unions, political parties, religious cult

organisations created accorded to Government Ordinance

no. 26/2000 and Law no. 21/1924.

By legal organisation type, there are commercial or non-

commercial enterprises. The category of non-commercial types

includes budgetary institutes, central and local government, as well

as non-governmental organisations.

The economic field includes commercial legal types:

autonomous bodies and national institutes, commercial

companies, cooperative and agricultural holdings. In this category

does not include companies developing social activities,

respectively teaching educational activities and sanitary

assistance. These activities are not assimilated with the trade

activity and can not provide commercial nature to the respective

company.

Mãrimea întreprinderii este evaluatã dupã criteriulnumãrului mediu de salariaþi, în perioada de referinþã, înconcordanþã cu criteriile emise de Eurostat. Se utilizeazãurmãtoarele intervale:

- întreprinderi micro: 0 - 9 salariaþi;- întreprinderi mici: 10 - 49 salariaþi;- întreprinderi mijlocii: 50 -249 salariaþi;- întreprinderi mari: 250 salariaþi

ºi peste.Activitatea principalã a întreprinderii este stabilitã în

funcþie de produsele sau serviciile a cãror realizare implicã celemai mari pãrþi ale resurselor umane sau care aduc cele mai marivenituri întreprinderii. Încadrarea întreprinderilor pe activitãþis-a realizat pe baza activitãþii principale codificate conformClasificãrii CAEN Rev.1.

Cifra de afaceri - suma veniturilor rezultate din vânzãri debunuri, vânzãri de mãrfuri, executarea de lucrãri ºi prestãri deservicii, mai puþin rabaturile, remizele ºi alte reduceri acordateclienþilor.

Datele privind cifra de afaceri nu includ TVA.Investiþii brute în bunuri corporale - valoarea investiþiilor

efectuate în cursul perioadei de referinþã în toate bunurilecorporale, cumpãrate de la terþi sau produse pe cont propriu ºi acãror duratã de utilizare este mai mare de 1 an.

Investiþii nete: caracteristicile investiþiilor nete suntprezentate în capitolul nr. 12 - Investiþii ºi imobilizãri corporale(pag. 514).

Exporturi directe reprezintã cifra de afaceri obþinutã deîntreprindere în urma vânzãrii la export a produselor ºi/sauserviciilor proprii, fãrã intermedierea unei întreprinderi decomerþ exterior.

Valoarea adãugatã brutã la costul factorilor - sumasalariilor ºi altor elemente legate de costul factorilor de muncã, aprofitului, a subvenþiilor de exploatare, a amortizãrii capitaluluifix, din care se scad impozitele legate de producþie.

Rezultatul brut al exerciþiului - diferenþa dintre sumaveniturilor din exploatare, a celor financiare ºi celorextraordinare ºi suma cheltuielilor de exploatare, financiare ºi acheltuielilor extraordinare. Diferenþa pozitivã reprezintã profitul,iar cea negativã, pierderile.

Repartiþia regionalã a rezultatelor întreprinderilor s-adeterminat în funcþie de structura unitãþilor locale active dinindustrie, construcþii, comerþ ºi alte servicii.

The size of an enterprise is assessed according to the averagenumber of employees, during the reference period. In accordancewith Eurostat criteria the following intervals are used:

- micro-enterprises: 0 - 9 employees;- small enterprises: 10 - 49 employees;- medium enterprises: 50 - 249 employees;- large enterprises: 250 employees

and over.The main activity of an enterprise is established depending

on the goods or services whose production involve the largest shareof human resources or which entail the highest revenues of theenterprise. Enterprises framing by activity was done based on themain activity codified according to CANE Classification Rev.1.

Turnover - the amount of income resulted from sales of goodsand commodities, execution of works and rendering services,excluding rebate, commissions and other discounts for thecustomers.

Data on turnover do not include VAT.Gross investments in tangible goods - the value of

investments carried out during the reference period for all tangiblegoods, bought from third parties or produced on own accounthaving a useful life of more than one year.

Net investmentes: the characteristics of net investments arepresented in chapter no. 12 - Investments and tangible fixed assets(page 514).

Direct exports represent turnover obtained by the enterprisefollowing export sales of own products and/or services, withoutbrokerage of a foreign trade enterprise.

Gross value added at factors cost - the amount of salariesand other elements related to labour factors cost, profit,exploitation subsidies, fixed capital amortisation, after subtractingproduction taxes.

Gross result of exercise - the difference between the revenuesfrom exploitation, financial and extraordinary income and theamount of exploitation, financial and extraordinary expenditure.Positive difference represents profit, and negative ones, losses.

The regional breakdown of enterprises results is determined bystructure of local units belonging to industry, construction, tradeand other services.
